If complaining about mis-selling they will be absolutely correct and you will have six years. However, there is an issue that may be prevalent that will have no time limit. Again request all information held on your account under the data protection act. Ask for a copy of the terms and conditions of the cover including who actually provides the cover. At that point it can be assessed if you have something to hit them with.I am a former Broker, former IFA and former compliance officer, for my sins.

I have begun a claim against First Plus. Nearly 3 years ago we paid off a First Plus loan early and got the shock of our lives. We did not realise that we owed them nearly £10,000 extra on top of our original loan - for PPI - the single premium PPI. I complained at the time but got nowhere and now our mortgage is £10k more than it should be thanks to them. It's something that me and my husband found really hard to put behind us, particularly because we were financially pretty vulnerable at the time.
So, I sent the first letter recorded delivery, adapting the template from this site, just over a week ago. I have today received a 'holding' letter from them, saying they'll deal with it before 14 December.
I won't let this one go and am prepared to take it all the way if needs be. What they do is nothing short of criminal. We are both intelligent people and they conned us. Who knows how many other vulnerable people they have conned?
So - wish me luck! I'll keep you updated on progress! And if anyone's reading this who has similarly been duped by First Plus - complain now! It's such a relief that this scam has finally come to light, thanks to Martin! Oh, and Carol Vorderman should be ashamed of herself for backing such a company.0 -
DITTO Millie -they sent a revised letter out yesterday supposedly - watching for the postie in the morning lol - they gave me the line - it was all in the brochure etc - but we ended up having to sell our house and go into council property because of it - all because the £7k+ policy did not cover us equally - we repaid after 2 years and paid over £10k more than we originally borrowed.
The solicitor who handled the sale of our house couldnt believe the amounts or their atitude so we'll see tomorrow hopefullyHappy with any wins this year :A0 -
Well following sending a 2nd letter "adapted fromthe template, I have received a 2nd letter from LTSB saying my my "file" has been allocated to an experienced memeber of the team who will be in touch shortly....so not sure who replied last time.Maybe an inexperienced member of the team....
And they will be in touch by 31st Dec. I will wait and see what happens.0 -
Has anyone actually commenced County Court proceedings for Misrepresentation, I'm assuming it would come under the Misrepresentation Act 1967 and be Negligent Misrepresentation instead of Fraudulent (given that the burden of proof shifts from claimant to defendant under Negligent Misreprsentation).
If anyone has started proceedings could they let me have the wording for the N1 claim form along with case law and any applicable court bundle.0 -

Hi I take it you want to reclaim back the ppi element because you paid back the loans early and didn't get a rebate on the ppi - if so then the FSA - Financial Services Authority have stated these 'no refund' contract terms may be unfair under the Unfair Consumer Contract Terms Regulations 1999. Go onto the FSA website - type into search ppi and the 5th or 6th item on the list is the FSA ruling on the refund of single premium ppis. You might want to add that to the template letter along with a copy of the FSA's ruling !!!0 -

on the 30th of October I sent 2 PPI reclaim requests one to GE Capital for a Burton Account and one to Littlewoods for an Index catalog Account.
I've received the Generic response from GE Saying they are looking in to it and I should wait 4 weeks.
But i have yet to receive any correspondence from Littlewoods, Which is not unusual as I had previously requested 3 times to cancel PPI on my account but had never received a reply or had the PPI removed.
I was wondering if anyone else has had any experience in dealing with Littlewoods regarding these kind of matters.

Worst Plus are going to settle in FULL! Everything! Paying back the PPI payments to the loan so that figure comes off the exaggerated settlement figure. Also, the interest is to come of the the settlement figure and the best is always last they are going to to pay me, by cheque - in my hand, the overpayments!!! They are recalculating the loan to lower the monthy payments as if the PPI hadn't been taken out and all the payments we have made to date coming off the original amount borrowed.
So for all those of you with claims still going on hang in there it will be sorted.
