  • What about putting a fan right by the window so it blows the smoke out before it gets in?

    Tbh its the increased noise that is the major problem although smoke can get in when its very busy .
    Ive noticed all the pubs round here I drink in getting quieter over the last 12 or so months. I put it down to the economy generally, a lot of people are starting to feel the pinch? Beer is one of the first things to cut back on unless you're 16-20.

    Ive come across that option when I was looking at the Licensing act 2003 Application for review of premises licence. Didnt think about it relating to the after hours drinking tho. :beer:

    Just one 'alternative' thought here, Paul.

    To go some way towards getting you off their back, they may be prepared to pay for replacing your loo/bathroom(?) window with a non-opening (and soundproof) window, complete with fitting an efficient extraction system.

    This would let light in but not sound and still give you good ventilation.

    This would only solve one of your problem areas, but perhaps the main one, and cut out much of the annoyance.

    if it comes to it I'll definatley try your suggestions, a triple glazed window would make a difference I'm sure, downstairs at least as the wall is over 12" thick.
    I dont know if you spotted my post at the bottom of page 4 about the LACORS legislation that my local council apparently follows? My local council has no local standards for shelters and they refer to the LACORS issued government guidance. I found the LACORS guidelines document and have asked the principal environmental health officer for their opinions on the smoking shelter/canopy. Normally I get a reply same day or next, this was over a week ago and strangely have heard nothing since. :confused:
    I pointed out the noise, light pollution from short timer radiant heaters and the fact that if it is changed to match the plans it will cover the exit to the pub.

  • Wheres the smilie for tumbleweed? Its all gone very quiet, apart from the customers the other night. :rolleyes:
    No answer from 2 emails to the Punch manager.
    No answer to my last enquiry from the Principal Environmental Health Officer.
    No answer from the planning dept about any of the other issues Ive raised.
    No contractors removing half of the smoking shelter or the paint from the side of my cottage.

    Well what a suprise.

  • Hi,
    not yet, I'm still trying to avoid it if at all possible. I'm going to wait until the middle of October before I start again with more messages and emails. That should be after the councils proposed visit to see that the planning permission has been complied with.
    After that I might as well contact the ombudsman someone mentioned earlier and the helpline to do with smoking shelters. Also a letter to the pub asking them to take measures reducing noise after 11pm as I think after is rather unreasonable.

    Just read all this with interest. A thought but have you got Legal Assistance with your Buildings Insurance - I think this might be something to look at as they have damaged your house and this cannot be right. Might be worth having a look at that.

    Paul Badwin I suggest contact one of your local councillors or MP to get them to chase up the envirnomental health officer. You may as well do it today. I've noticed with my local council that if I get my MP or a councillor involved they actually bother doing their jobs.

    Also see if the local paper is interested. Punch Taverns will not want bad publicity, and newspapers like these kind of stories.

    After this get a solicitor involved. You are not suppose to talk to the press after you have a solicitor involved because if you do have to go to court this will look bad on you. However a friend of yours is allowed to have contact with the media on your behalf if the a soliictor is engaged before you get around to doing your press interview.
    I'm not cynical I'm realistic :p

    Was there any outside drinking area previously? I mention it because a pub round our way was forced to effectively close their newly created pub garden/smoking facility as their license did not allow alcoholic beverages to be removed from the premises and the plan deposited with the license indicated that the premises was only the building. I think the pub applied for a new license and is now allowed to use said garden subject to some condition relating to noise.
