Nuisance pub next door

Hi,
the pub I live next door to has recently had a re-fit. There is a passageway between the pub and my house, it was originally a coaching inn so has been there for 400 years or so. Punch Taverns have recently applied and won planning permission for an erection of a canopy (not a smoking shelter) in the passageway between the two buildings. They have now erected it and it ends 6 inches from my wall and covers one of my windows. As you can imagine you now cannot open the window without excessive noise from punters and cigarrette smoke entering the building. Smoke is also entering the property under the eaves, blocking them is not an option as the roof timbers are original and this will cause them to rot. They do not appear to have any of the guidelines for smoking shelters in mind when it was erected but still got planning permission? :rolleyes:
To add insult to injury they have also painted the whole of my house on the one side in modern waterproof paint not limewash, without asking for permission and installed some gates that directly block daylight through my windows when the gates are open.
Previously to this the passageway was for access to the rear of the pub but now its a permanent seating area outside my window.
As you can imagine it will have knocked a fair few thousand pounds off the value of my house, could anyone kindly point me in the right course of action to get things sorted, amicably if at all possible.

Have they complied with the Planning Permission "to the letter"?
If there is any variation between what they've done and what they were granted permission to do, you can contact the Enforcement Team at the local planning authority.
As for painting your house ...... OMG :eek: Raise a complaint directly with Punch Taverns and insist they rectify this. I can only imagine it was their contractors who, presumably, were not supervised!Warning ..... I'm a peri-menopausal axe-wielding maniac0 -
You'll get the helpful "You shouldn't have bought next to a pub" comments later. In the meantime, speak to the LL and ask if something can be done to solve the problem. Failing that, ask again in writing and copy Punch Taverns.
If nothing can be agreed you may have to play dirty. Surely some pungent smell/boom-boom music can be sent from your house through that window.

surely if you cant get punch to sort themselves out you can sue them?:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.

They can't paint your wall! You have to take that up with Punch. I'd really take them for a ride.
As for the canopy, gates etc - contact the Planning Department and ask if they can send someone down to you to look and discuss whether it meets criteria and also complies with the new legislation.
It can't be right with the smoking ban that you have smoke drifting in to your house. There is legislation about distances and smoke not being able to drift back into the bar, so it must apply to your house. If the gates block light to your living accomodation then this could be an issue also.Everything that is supposed to be in heaven is already here on earth.

now you have to go into a pub to get away from the smoke.
as well as checking the planning permission & any variations, I'd also contact the pollution control dept of your local council. they deal with noise and smell nuisance too, and will send people out to measure the nuisances you are suffering. They normally work at night too, and especially at the weekends.
not sure about whether you can do anything about them having painted your wall. Is it a party wall, as it forms the boundary of their property? I've certainly never asked before painting a wall in my own garden - on the other side it is someone elses wall/garage/house etc.0 -

That I'll have to look into closely, I did have a brief conversation with the contractor who said he didnt follow the plan exactly and tilted the roof away from my property for starters. Only trouble being if this is corrected the smoke will go up directly under my eaves.
The contractor also admitted being under orders to paint my property, it was an extra they didnt want to do. Pity this conversation wont mean a thing as it was after several pints of beer.
As for comments about buying a place next to a pub, carry onI am of the philosophy if you cant beat them join them most of the time, its been my local for over 17 years! We put up with more than most would ever put up with and have never made a previous complaint.
As for playing dirty I really genuinely hope it never comes to this but if it does I am quite capable of being extremely creative

Your thoughton the wall on the other hand as it does form part of their boundary obviously. Saying that I did catch them trying to fix the posts to the wall too. I told them to stop what they were doing and floor mount them which they did. Still went ahead and painted it though0 -
Painting your wall without your permission is the same as some vandal spray-painting graffiti on it i.e criminal damage."You were only supposed to blow the bl**dy doors off!!"0
