Hi, matto, yes, people did have the right to drink in the beergarden at the back as far as I know
My councillor is aware of the problem.
I'm still waiting on the outcome of the paint so havent approached a solicitor as yet0 -
Update.
Just had a meeting with Punch. He asked whether it was a party wall. I said I didnt know. I also asked that if it was and they had a right to paint the wall in the wrong materials causing damage the paint would say. He said "I'm not saying that"
The councils environ health has been round, they have no objections to the shelter apparently even tho it is against the guidelines.
The planning enforcement officer has visited and has found that it doesnt contravene the planning given, even tho I recieved an email from planning that contained a letter to the pub saying that it did.
Punch can see nothing wrong with people drinking out there till 1am. I have asked them to erect signage as a token gesture for noise to be limited after 11pm.
Have also asked him to see if the chiller unit can be adjusted so it doesnt go on and off all night long.
Not at all happy really, feel thoroughly let down by the council especially0 -
Could you not open your side window and play celine dion at full volume until 1am? that should make most people move! Or maybe keep the window closed and have a machine that periodically drops stink bombs into the alley (those little glass pellets that smell SOOOOOOOOOO bad!).
I can't believe the council haven't put a stop to this!! Keep fighting it though, because it blatently shouldn't be allowed! (plus if you ever wanted to move, it would also make it very difficult to sell your property!).Should've = Should HAVE (not 'of')

Sounds like you still need to hear from the Council yourself, especially why they appear to have approved a smoking shelter that is against the guidelines, why they appear to allow people to drink outside (in an area that was not previously used for drinking) till 1am and why they haven't answered your concerns about the planning application.
It's probably worth taking the matter of the chiller to environmental health too, if it's worse after the refit, I would have thought they had an obligation to minimise nuisance to neighbours, not increase it....0 -

Ask yourself this- Why would Punch's lawyer tell you the truth? Punch want to make as much money as possible for their shareholders and you complaining stops them. The lawyer has a large corporate client, who they can keep longer if they successfuly get rid of small people like you.
I would ask for in writing for written confirmation from the envirnomental health that the smoking shelter doesn't breach regulations.
I suggest you log the noise incidences separately as per information on your council website. And then send monthly reports of the noise incidents to the envirnomental health pointing out how it breaches the licensing regulations. (You need to read up and quote exactly what law they are breaching.)
Complain about each problem separately to the correct person in each council department even if it's the same department. The council will be able to cope with this because they have different people dealing with different things but Punch may not as it's harder for one person to keep track of multiple complaints.
In future if Punch or anyone says something like your wall is not a party wall just say it is. As a lay person you have the priviledge of being able to make mistakes on legal matters. Once you have a solicitor advising you have to be more careful.I'm not cynical I'm realistic

The OP seems to have done everything in his power to resolve this amicably, & I personally think that if he'd been a bit harder on Punch & the council this would have been sorted out already. But he's the one living there, not me, & he realises he's still going to have them as neighbours until either he moves or they do. However he gets it sorted out, he has every right to complain & keep complaining until it is.BSC #53 - "Never mistake activity for achievement."
