    There is also an article in The Publican magazine http://www.thepublican.com/story.asp?storycode=57445 If you look at the bottom they are requesting people who are experiencing issues to call their newsdesk. It might be worth a try...

    Yes but, being The Publican, it is actually asking to hear from publicans who are experiencing problems with their neighbours.

    Maybe Paul should show it to Punch?

    Hi, well after getting hold of my local councillor and having the case reviewed I've had the result come through. The council has found no problems whatsoever with the shelter, its location or the positioning of the gates :cry: Even though it's been admitted that it was a comittee decision and there was no site visit and the windows shown approximately in the drawing below have been omitted completely and one gate set installed in the wrong position! Theres also been no word from the brewery rep whatsoever about the paint.
    Could anyone point me in the direction of how to find out if my wall is a party wall and what procedures neighbours should go through before they do anything to one?
    It appears the only thing I can do now is put in an official complaint about the council.
    I've prepared a fair bit of stuff now and am going to book an appointment with the CAB, the councillor is also not happy with events and is looking into it further.

    Read this thread a while ago and have just seen it's re-started. Have you looked at perhaps using claim of damage to your health from fag smoke as a result of the council approval action? perhaps suggesting that you will sue them for approving a situation that results in smoke entering your home from another property?
    Or threatening to do the same to the brewery?

    Paul - go to the RICS website www.rics.org 'Find A Surveyor'. Look for one that specialises in party wall matters. Some give 30 mins free advice over the phone.

  • Paul - get hold of a copy of the registers of title for your property from the Land Registry - this link will help you find the contact details http://www1.landregistry.gov.uk/regional/. These registers are effectively "the deeds" and may well contain details of who is responsible for the boundary. It may be that rather than setting the information out in the registers, it refers to another document, which should also be obtainable from the Land Registry. It would be interesting to see whether any has legal right of way over the passage (which is being obstructed) or whether by doing what they have done, the brewery is in breach of any covenants.     I have just read this complete thread. You have a dreadful problem.
    Looking at your posts you seam to be a very nice chap. I think that maybe the problem. You have let a lot of people fob you off, you have sent emails when recorded delivery (or hand delivered) letters would have made it more personal. You have at all times thought that other people would act in a fair and reasonable manner.
    Very sad to say but I suspect an angry "in your face" approach from the beginning would have brought a different result.
    Stop being a nice chap. Start all over again as if the last 12 months of softly softly approach had never happened.

    What department of the council was that, Paul? I assume it was Planning, who must think the smoking regulations are unconnected with planning decisions (and probably they are).

    It's obvious from the plan that it's completely illegal from a smoking point of view, as over 50% is enclosed. Badgering another department may be in order.

    And I have to agree with gfplux, you've been far, far too patient, it's time to get nasty.
