Calm down dear, calm down. Are you a smoker who is annoyed at the smoking ban?RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

Read the thread mateIve been drinking in the pub for 15 + years, living here for the last couple. It was never a problem before the council gave them planning permission. :beer:

I forgot to mention the punch manager I spoke to also said I shouldn't have bought a house next to a pub, cheeky sod
I heard back from planning yesterday and they have changed their tune. They said initially that the shelter should have stretched halfway across the yard. Now it seems that they are happy with it the way it is apart from the fact the roof is angled more than it should be. The lady in planning informed me that environ health are not happy for the tables and chairs being nearer the pub as it is too near the door! So its ok for the smoke to come into my property but not into the pub?0 -

I think you should press the point about your (opening) window being a great deal nearer than the pub door.
I think the council are failing you badly here, maybe you need to up it to the main Council instead of these departments/committees. Do you know your local councillor? I suspect you might be able to get him wound up.0 -

Ive written to my local councillor about the issue and they said they'd look into it. I got a reply to my first email but not the second. Ive sort of known her for many years but only to say hello to, she used to own the local store I used to buy sweets from as a kid. I dont think she'd have put my name to my face though.
I was thinking of now ringing the smoking shelter helpline number and asking them if they had an email address I could forward the photos to. If they thought that the shelter was against the guidelines and I had a case I would then give the name and address of the pub for them to follow it up.
Looking at the Lacors legislation guidelines it fails on numerous counts?
The Punch manager I spoke to admitted that it was only positioned there as the obvious spot inbetween and furthest away from neighbouring properties was not as asthetically pleasing. Thus not maximising there business potential. Even though there is no need for them by law to provide a smoking shelter at all.0 -
I've noticed that you've mentioned writing numerous emails throughout this thread.
Can I suggest that you start writing letters instead, as it's much easier for the council / brewery to ignore an email in their inbox than it is to ignore a physical letter. It also lets the recipient know your serious about your complaints/concerns.
Sending letters recorded delivery will also allow you to confirm they've been received, and will ensure that THEY KNOW, that you know it's been received, again speeding up a response.
Finally, it would probably be worth while keeping a log of all correspondance whether be email, letter or phone in a notepad (just date, and summary of communication, along with time and who you spoke to if it's a phone call).
I also hope you don't mind me saying, but it sounds like alot of people are messing you around here. As someone else mentioned try to escalate it to the council, and with regards to the brewery, write to the head office and let them know of some of the more dubious comments the manager has said (such as "the punch manager I spoke to also said I shouldn't have bought a house next to a pub").
It's time people start getting a b*llocking for not follwing rules etc, as it's now not just causing you problems, but a major inconvenience in all your time trying to sort it out etc.

All the emails I've sent and recieved so far have been kept in a folder, the dates and times are all recorded by the pc each time they are created. I have also kept a diary of phone calls with the council and the Punch manager.
I've been waiting for the visit by the enforcement officer and environ health before I started things up again. I was under the impression that the shelter was going to be physically reduced in size which would have made it less comfortable for the customers, thus reducing the problem. They didnt notify me of the outcome tho, it took the convo with the Punch manager to find this out.
Now Ive met the chap, I have a fair idea that nothing is going to get done dealing with him. Each time I raised a point I didnt get a response. I must have mentioned the unsociable hours 5 or 6 times in the 15 mins I was talking to him. It seems that noise after 11 oclock is perfectly acceptable as they have had the full backing of the council. Before the refit the side doors have always been shut after 11 and customers had no choice but to use the front entrance, hence the problem being so much worse now.
I'll ring the smoking helpline on Monday morning and write a letter to Punch's head office. Its now obvious things are not going to work verbally and amicably but I wanted to at least try0 -
You need to see a solicitor. There are a ton of issues here. Not just the planning, but also boundary issues, easements, nuisance etc. etc.0

Thats what I was trying to avoid but it is most definately looking like that now
Ive been looking at the plans and the deeds but cant see anything that refers to that wall in particular. Does anyone know who you have to apply to to find out?
