Good evening I hope someone can help / reassure me

I saw a watch on eBay and contacted the seller. The seller requested I pay via faster payment I declined.

The seller setup a worldpay account I paid for the watch via his website. I also purchased the item through eBay & the seller marked it as paid on his request.

The seller dispatched the item via special delivery I should have recieved it by 13:00 the watch wasn't recieved by 13:00 it was attempted to be delivered whilst I was out at approx approximately 15:00.

I picked it up the following morning from the Royal Mail depot but didn't open it until three days after due to being away / busy.

Inside the package was one Rolex box but no Rolex.

The seller claims it was sent in a tamper proof bag & then in a separate jiffy back inside. The seller has since shown me what the tamper proof bag looks like, I didn't receive this bag but just a grey bag with my surname / postcode which was filthy this was taped down by parcel tape (I disposed of this on the Friday due to it being so dirty prior to opening it three days later) inside was a white jiffy bag with full postal markings etc.

The seller claims the watch was sealed & checked by the postmaster.

The seller is now claiming I have removed the watch and now am trying to claim there was no watch inside.

The seller cannot understand why I didn't open it on the Friday but waited until the Sunday - as previously mentioned I didn't have time to open the white jiffy bag. Whilst opening the white jiffy back I videoed it so I could relive the moment I saw what should have been my new Rolex for the first time.

The seller claims he has followed all procedure and his "story" is watertight.

On the Sunday I contacted Barclaycard as I paid on Credit Card. I then contacted the Royal Mail who couldn't help I also reported it to Action Fraud & also went into my local Police Station all on the same day.

Conversation has now broken down between me and the seller, he claims I have stolen the watch & has told me he's reported me to the Police. He refuses to refund me or claim through his insurance.

The company that sold me the watch is fairly new but claims to have happy previous clients who have left reviews. The seller is just one person who has created a limited company. This was his first worldpay transaction.

Do I stand any chance of winning this battle. I did sign for the package at the depot & there wasn't any sign of the package being tampered with. The watch in question is valued at just under £8000 it was all paid via credit card. I am worried about the Police knocking my door (not that I have anything to hide) but I've never had any dealings with the Police previously.

Will my dispute with Barclaycard likely be upheld?

I did insure the watch prior to taking delivery on my home contents policy if this could offer a solution.

Thank you in advance

The outer packaging would really have helped to show whether the parcel had been tampered with or not.

As you have thrown away the outer packaging, I fear you are going to struggle with this.

No I haven't. The postmaster is apparently a friend of the seller. I am not sure who the postmaster is.

I did check our communal bins as I live in a apartment but unfortunately they have been emptied otherwise I would have retrieved the outer packaging.

    What do you mean apparently.
If you have this in writing that the postmaster witnessed it, it's the first thing you could obviously disprove. I can't understand why you wouldn't have asked for his name and spoken to him at his place of work.

I do not have anything in writing that the postmaster witnessed it. The only person that has told me the postmaster witnessed it was the seller himself via telephone call & text.

I cannot understand anyone expecting a £8000 watch to arrive through the post not to inspect it at the first opportunity.

    Especially one bought via ebay.

    Incredible.

It wasn't purchased strictly speaking through eBay I just saw it on eBay. I have spoken to the seller on many different occasions whom sounded geunine. He even offered for me to speak with previous clients of his. It all seemed very geunine.

Unfortunately I was going away for the weekend and didn't have a chance to check it & didn't want to take it with me.
