Compared to others here, I feel a bit of a fraud, but I am almost totally disabled today. I tripped over a bollard yesterday and fell quite heavily. I thought it was just a grazed knee and walked home. Then I got dragged round shopping. Today, I can't put any weight on my knee or even bend it. I tried going downstairs but gave up. It gets really, really, really painful if I bend it more than about 60 degrees. I guess that I have bruised something inside.lostinrates wrote: »Why fraud?

I have to go to court in the morning. Car accident four years ago - a very simple case of someone slamming into the back of me until they fabricated a witness.
I've spent years arguing with my own insurers about getting this witness to testify - see if they will perjure themselves.
Fmound out a month ago that the witness refuses to communicate with either solicitor. Surprise. Their statement is being submitted as a 'hearsay statement' which my sols say won't be accepted. It's been written by someone with awful handwriting - a mixture of caps and lower case, who refers to 'the car' and 'the silver car' but manages to state that 'The third party' is to blame. The third party being what I am to the other driver, not a witness, surely?
The other driver's statement doesn't metion the witness at all, nor an opportuntiy to speak to one. This wasn't reported to the police and I don't know who they could have proactively contacted when referring to a dark car and a silver car?
I've spent the entire night picking apart the other witness statement apart and ordering my comments for the barrister. Not remotely tired, very stressed and my anxiety has returned for this. Need to dig out some propanolol in the mornung or I'll be a jibbering mess. I broke down in front of a parking ticket adjudicator last time

Tyre performance in the wet deteriorates rapidly below about 3mm tread - change yours when they get dangerous, not just when they are nearly illegal (1.6mm).
Oh, and wear your seatbelt. My kids are only alive because they were wearing theirs when somebody else was driving in wet weather with worn tyres.0 -

DG, good luck tomorrow. I reckon the court will be well suspicious of the witness who nobody saw. You might as well pull out the Ghost Who Never Lies as your own witness!
Back in the 60s my dad had just driven out onto the road when a car hit him. Nobody was hurt but my dad had just returned from the US and had a fancy new camera with him in the car that ejected the photograph out the front and it developed on the spot (a version of the Polaroid Land Camera) but nobody here had ever seen it before.
He leapt out of the car and took photos of all the scene and the witnesses and asked for their addresses to write on the back. Brilliant it was, as they could verify the other guy was in the wrong and they all treated him like he was in charge. I had the exact opposite. Someone went in to me on a midi roundabout. A young female driver, with a male passenger. Eventually gets to court driver attends with mother. I asked where the passenger was, why no witness statement etc. She totally denied the existence of the passenger. Mother clearly confused as she thought her daughter was alone in car. Daughter (driver) was asked by the judge where she was going at the time and daughter claimed to be just driving around aimlessly. Judge disbelieving. I won case.
It did make me wonder how easy it would be for someone to ask about a fictitious passenger, in the hope it would make the opposition look less reliable.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
