he obtained your VRN from the DVLA whilst stilll a member of the BPA so has to provide a popla code, even if he has since left the BPA (or been excluded)

he , the BPA , POPLA and the DVLA all know this as it was agreed last year

so if he doesnt abide by those rules and issue one (or cancel) you can and should report him to the DVLA and the BPA , regardless of current membership

by not allowing ADR by POPLA he is denying you your lawful rights , so create a paper trail so if he is daft enough to go to court you can bring up this evidence in court, as well as no locus standii etc too (plus his expulsion for the BPA for these sharp practices)

"so its cancel or popla, or I will report you to the DVLA and to the BPA, plus the judge if you are silly enough to try small claims court"
  • however as he is no longer a member of the BPA , and at present not using KADOE to obtain information from the DVLA, can either actually do anything?

they can huff , they can puff , but can they act?

the BPA have been caught out as liars , look at my post yesterday , covering there non members

    Thanks for the replies.

against the recommendation - i did just call them back and spoke to a lady who I asked for my Popla code.

"We are not a member of POPLA now so we do not have a code to give you"

I said, the time of the incident was when you was with POPLA/BPA

she said, my appeal letter did not come through while they were a member

    Any suggestions?

p.s. i recorded the telephone call

You will not get a PoPLA code out of them. Who's gonna sanction them?

Just ignore the tosspots except in the vanishingly unlikely event of them bringing a real small claim.

when , as in what date did you reply to the NTK , and please say you got proof of posting from the PO

ANPR WERE member of the BPA uptill 2nd April 2015 , as per pranky http://parking-prankster.blogspot.co.uk/2015/04/anpr-ltd-no-longer-members-of-bpa-aos.html

and according to the BPA dated 13th april

The British Parking Association (BPA) has terminated the membership of ANPR Limited with immediate effect

    http://www.britishparking.co.uk/News/bpa-terminates-membership-of-anpr-limited

    and the Muppet himself

    Change

It is rumoured that ANPR Ltd are no longer members of the BPA and that we've been 'Kicked Off' off their Approved Operator Scheme. I can confirm that the rumours are 100% true. Ironically our membership was due to expire in March and we made it blatantly clear we will not be renewing our £5,000 membership.
As expected we anticipated a change long ago and have initiated our contingency plan.
    01/04/2015

mmm , was he getting details from the DVLA whilst not a member of an ATA ? he admits that " Ironically our membership was due to expire in March" , so has he been acting illegally between those dates? one to remember for future

so we can go with pranky , or use the system to effect , BPA say 13th april.

you say "i received a ntk in the end of feb and early march " so unless you sat on that till 10th april (+ 2 days posting time) they are lying

no POPLa code , no party

    Hi and thanks.

I sent the appeal by royal mail recorded delivery on the 1st of April (not april fools).
The letter i sent was dated 29/03/15 (appeal) + a secondary cover letter (undated).

I am having trouble finding the recorded delivery receipt, but i can see when I posted it from my "google location history". If i can't find it, i'm hoping the post office can do something for me (i know them well).

But -- I have now noticed they have written on the letter they sent to me :

"having read your letter dated 19/04/2015" -- which is a complete lie.

and i have now listened to the call in which she said "we only received your letter dated 19th of the 4th"

I have the original letter with the date on it (in word format) 29th/March/2015..

I hope the lady at the post office can do something.

We are dealing with Trev the div but even he should be able to work out the relevant date is the time of the alleged contravention.

However as Bazster has said you wont get a POPLA code of them. It was difficult enough when they were BPA members.
