How can you stay a case that has not been stayed in the first place pending an appeal to see if it can be stayed? Status quo surely here and proceed until otherwise?

Yes, your correct but what has happened so far, is that claims have been in limbo until the Allen Judgemnt.

For example I wrote way back in November to Leeds CC, to get my stay lifted, the posts in the J2 forum that we worked on together.

I simply never received a response from the Court, they basically put all the cases that were awaiting 'Huzar' to one side, pending Allen. Note the post from Dr A in the J2 thread. Now it's for the courts to re-list them post Allen.

    Cheers,

By the way if your following this thread and you do get a settlement because of the Allen case, please post the details here, as it's still early days and we're all waiting to see the Courts and the airlines reaction to the Judgement.

Just to remind us all what J2 actually said in the letter to the Courts back in November 2014 https://forums.moneysavingexpert.com/discussion/5112736

And just to be absolutely clear

    Continuation of stay

    6. We therefore request that the court continues the stay of these proceedings until the outcome of the reference in van der Lans v KLM. In making this request we refer to the following matters:

    Case dismissed!

    Hi folks

Gosh what excitement although "chickens count hatched" etc is a watchword.

    1. If your case has been 'stayed' I suggest contacting the Court rather than the airline. This is what I have done.

    2. In my case Jet2 actually requested a stay until the outcome of the Liverpool case, rather than the KLM Appeal. I think this was a slip but when Jet2 come back with an Appeal (as 2 Birds will advise them I am sure as it will 'earn' another squillions of legal fees for them) I shall use it.

The Judge in Harrogate seemed a tad tetchy in her last correspondence to Jet2 so here's hoping.

I shall communicate the decision of course. Have a good weekend!

Who let you out of the J2 thread ;)

Yes, I think if anyone looks through your posts, they will be quite surprised to read the history of your case.

Yours is the only case that I've read about that has referenced the Allen case, all the others seem to be in line with what Flightclaim posted back in November.

It's based on a tech, so post Huzar and now Allen the compensation, (sorry Charles)WINDFALL is almost yours!

Not only a tech, but a tech occurring about 2 flights previously...

    We shall see.

I expect they will want a return on their investment, so expect more pointless appeals and stalling.

Jet2 is owned by the DART Group and based in Yorkshire. As a fellow Yorkshireman I am sure they hate wasting good money.

They have been told, one guesses, by their legal advisers, that if they throw enough money at lawyers and barristers they will eventually get these cases thrown out.

I enjoy imagining DART board meetings as the Chairman says "Ey up Steve lad, what's t'news on delayed flights" and gets the reply "Well Phil, we 'ad t'QC - cost a bomb - and lost again".

The time must come when Phil says "Enough, lads (there are no women on the board  ), this is costing us a fortune on people who can't deliver and we are becoming a laughing stock".

Unfortunately this only happens after a boardroom coup - new directors coming in with a new broom - any chance of this do you think?
If not no director is going to look stupid by backing down now.

Good point. However, DART is a PLC with (now nervous) shareholders. If you held these shares how would you feel? Precisely.

Over in the Ryanair thread :
Just spoke to Bott & Co who informed me that the airlines have 21 days to appeal and that Ryanair have indicated that they will appeal but have not done so yet.

21 days then not 7 as previously thought :(

    Thanks for the info Justice13075
