    More news today about the Allen case on Radio 5 Live, MSE's Martin Lewis and David Bott from Bott & Co discuss flight delay compensation, worth a listen, last half hour of the broadcast.

    One does wonder what on earth they are going to appeal on, given there is NOTHING new, no grounds for appeal since the CoA Huzar case.....

    I think the birds would have to appeal that the DJ erred in law when reaching his Judgement.

    But in what way? They have offered nothing new since the SC hearing. DJ cannot overule the SC......

    I haven't a clue JP, that's for the birds to work out, but I think that they'll dig something up. They'd argue black is white!

    This is a real puzzle. On their own website 2birds reveal their opinion that this duck is dead:


    "it is difficult to see how a carrier could ever invoke an article 5(3) defence successfully in the case of delay or cancellation caused by a technical problem – if an unexpected, unforeseen and unforeseeable technical problem is insufficient, what technical problem could be sufficient?"


    Yet clearly they have been helping Jet2's attempt to revive the corpse. I am sure they are giving honest advice to Jet2, which will be "Sorry, you have lost, give in graciously", so I am guessing the resistance is within DART.


    One is almost tempted to buy a few shares in order to attend AGMs. These shares are actually doing quite well!

    Update... the shares lost 15% the day of the Supreme Court ruling but have since recovered somewhat. The Motley Fool reckoned it was a 'buy'!
