No it does not, all it means is the amount shown on the gc is shown as an amazon GC on the amazon account, Amazon account dept then at some point in the month will claim all monies from their resellers minus any commission fees in the same way a supermarket treats third part gift cards/vouchers, so do this it is the reseller (poke.io) that have the funds and that is the ONLY company the OP has any contract with.
You're agreeing with what I said. If the money is not in Amazon's account now then that's only because the process has not completed.0 -
Sure, I'm in favour of Amazon keeping the money. I haven't even bothered giving any advice as to how he may get any money back. I'm assuming you're just writing nonsense to wind me up.
The court scenario as I see it...
OP: Judge, Amazon have my £300.
Judge: So you have given them £300?
OP: No, I bought a gift certificate and they wouldn't let me use it.
Judge: So did you go back to who sold you the gift certificate and ask for a refund?
OP: No, I took the advice of a bunch of morons on an internet forum and came to court.
Judge: Can someone bring me some new underwear for I fear I may wet myself from laughing?
Why don't you quote the section of the law that explains using fake details robs the OP of all his consumer rights?0 -

It doesn't matter, it isn't in the least bit relevant until we know whether Poke.io can get the money back or not.
You don't live up to your name do you?
It must matter, you've mentioned it at least twice.
You admit it might be relevant, so why don't you quote it while we wait on the OP to return?0 -
but Amazon dont have his money unless
And there we go, we don't know the answer to that, so you are making assumptions here.
If Pok!mon sold the card in good faith and with the money on it and Amazon have raided it and emptied it, so that it is now worthless, then yes, the OP would get their money back in court, unless there was criminal fraud.
Breaking Amazon's T&Cs does not override English law, despite what they and their ilk (ebay) would like to think.
All the stuff about under age and double accounts is just a Red Herring. The OP needs to find out where the money lies, in Amazon's coffers or are Pok!mon able to withdraw it from the card and credit against another purchase.
Forget T&Cs, remember English law.0 -

It is still irrelevant until OP knows where his money is. Either Amazon or Pock.io have it or can access it.
If it does turn out to be Amazon, which I doubt, then the fraudulent opening of the account would make a significant difference to any legal case..0 -

No. it works like this
the buyer purchases a GC from a reseller (poke.ie in this case)
the reseller gives a code number to buyer
the buyer then goes into their Amazon account and enters the number into the gift card section
Amazon then show in the customers account a gift card to the value of ££
the number the buyer gave Amazon tells Amazon which reseller sold the GC and for how much, these details are passed onto Amazon accounts, who will then invoice their reseller for the funds minus any commission. This will only be done once a month. so all Amazon have is a note that you can purchase goods to the value of x amount and they will claim this from their reseller at some point during the next month0 -
Just to precis this thread, we need to go back to the opening post.
In an email, Amazon said that OP
"should refer the matter to the company or person who provided you with the gift certificates; perhaps they could provide an alternative."
OP, then asked
"Now, what am I supposed to do?"
The second post should have been....
"How about contacting the company who provided you with the gift certificate as Amazon suggest?".
There we go. No we can delete all the other comments and get my blood pressure back to normal..0 -
so when the OP returned he just needs to use a method from here https://pock.io/contact0

Brooker_Dave wrote: »Is this where we pretend that Amazon's T&Cs overrule UK law?
We don't have to pretend anything because Amazon are registered as a company in Luxembourg and it is the laws of that country that apply and not the laws of the UK.
What are the laws of Luxembourg that relate to this matter?
I've absolutely no idea. Do you?0
