Hi there
i have lodged a claim with my bank - Natwest - and although they have acknowledge the case and suspended a decision until the OFT outcome, interest continues to accrue and they have now suggestd that this will affect my credit rating.
Please help

Not sure if it's been stated elsewhere and not even sure if this is the right place to put it but:
Anybody who is still (rightfully) continuing to claim for their credit card charges MUST make sure in the particulars of claim on MCOL that they state clearly that this is for a Credit Card account. I've just had a defence issued by RBoS on my Fiancee's Mint credit card claim because they couldn't tell the claim was for credit card charges. I will now have to go through a lengthy and time-consuming process to amend my claim and re-serve it on them in order to get to court before the test case is heard.

Really hoping somebody can give us some advice. My boyfriend currently has a case going through the courts in Northern Ireland against the Bank of Scotland for almost £2000.00. The original response date for the case was 17th July and Bank of Scotland did nothing. Going by the advice on this site, we took that to be a "win" and requested a judgment by default. This was requested on 18th July and the case transfered on 24th July. Of course, since that date, the banks have announced the test case but, having read the emergency bulletin on this site, we thought this case would still be classed as a win and so, we would still get the money refunded.
Having heard nothing, we phoned the courts today to be told that all cases on the judge's desk, no matter what stage they are at, have now been put on hold until February 2008 at the earliest and so we will not be getting any refund.
Is this correct?

The charges where there when you signed up and I am firmly with the banks on this one.0 -
i am in the middle of it all too, i have sent the letter of to the bank with said £10 which the bank cashed at once then sent me a letter out dated 03/07/07 confiming this also so in the letter is " Within the terms og the act we have 40 days from the date the fee was paid in( cashed 26/06/07) which to provide you with the information we hold, and we will forward this to you in due course."
Does anyone know if they mean worknig days or calander days? if so the i am over the 40 days now what would be my next step?

Hi I sent the 1st letter months ago claiming back overdraft charges (only for £60) to RBS and never heard anythting back!!! Have been meaning to write back to follow this up and also claim some additional charges t hat have happened over the last 3/4 months(again only a small amount of £120).
Yesterday i received a letter from RBS stating all about the legal proceedings with OFT and as a goodwill offer they want to refund me the full £60 as a "full & final" settlement.
Do I accept or do I try & claim the further amount??

The Yorkshire Bank made me an offer for all my bank charges, which I sent back the acceptance letter and was told I would get the cheque shortly. I had started court proceedings.
I have now received a letter from the bank and from the court saying they have requested a stay, since the oftel ruling on the 27th july.
i was under the impression that all cases agreed prior were to be paid???.
I was wondering if any one has advice on the hardship ruling, as I have £50,000 worth of outstanding debt on credit cards etc, due to a falled business, which i am slowly paying, at a token payment of £1.00 per month, however I do not have any surplus monies to live on0 -

Bank accounts used to be an option, but are now almost compulsory.
It is likely that people with little or no money will go overdrawn, resulting in a charge that is a massive percentage of their income.
At the same time, a more well off person enjoys it all for free. How is all that fair?
Lets go back to cash for wages and bills, and scrap direct debits, standing orders, and cheques etc, and i may agree with you.
But until then, support a system that rips off the poor? Not a chance.0
