Bank Charges OFT Test Case Discussion

I recently used my check book when there was no money in my account. (there should have been - but my mistake) My bank has then charged me £39 per check, plus £25 overdrawn fees. These charges are more than double the amount spent on my check book, which I am happy to repoay as I spent the money.
Can I now advise my bank that I will be repaying the money spent using my check book but that I will place the repayment of the charges 'on hold' until the outcome of the test case??
Figure that they are allowed to do this, why can't I??
Realise I may just be trying to be cheeky, but thought it worth an ask!:rolleyes:0 -
What makes me laugh is that I could not get an current account as my credit file was not 2up to scratch". So was offered by my current bank a basic account with no facilities. When it comes to reclaiming they tell me the OFT test case is for all accounts including this one (funny how NOW it is considered a current account)!!!!!!!!!!!!!!!0

I am already in the process of taking Halifax to court.
They have been given 4 weeks to put in a defence.
Does anyone know how the OFT decision will effect this?0 -

HI ALL I HAVE BEEN FIGHTING A BANK CHARGES RECLAIM FOR OVER A YEAR WITH LLOYDS,THE AMOUNT OF CHARGES IS 7954 WHICH THEY OFFERED IN FULL,BUT MY SOLICITOR REFUSED IT OH NO,AND IS PUSHING FOR 13697 WITH THE INTERST AND FEES ON.NOW THEY SAY THEY CANT MAKE ANYMORE OFFERS TILL AFTER THEY CASE. DO BOG MY SOLICITOR OFF AND TAKE THE 7954 AND WALK?:mad: OR TAKE THE GAMBLE ON THE CASE.HELP!!!!!!!!!!!!0

I followed the route on your site and every step of the way I have just missed out. I had a court case going to court on the 29th of this month, was due to get my bundle together for tomorrow. Yesterday however, I had a letter from the court putting a stay on the proceedings until the OFT case!! I am in much need of the money. My husband started his own business, we cannot get an overdraft because of my account, I am company secretary and my account is overdrawn because they have charged me nearly £4,000! We are in arrears with our mortgage and credit cards and this money which was so close and yet so far would sort us out entirely. How do I state my case with the Ombudsman? Do I stand a chance or should I just hang in there? I turned down £2,500 and I really wish I had taken it. This has been going on since Feb and I am so stressed out about it!
Please someone give me some advice.0 -

I have tried to reclaim my bank charges and The Yorkshire Bank recently wrote to me to say they have stored my complaint but cannot deal with it untill the test case is settled. They have said that the FSA requires them to ensure that my complaint will not be adversely affected by the delay in dealing with it. My charges go back 6 years, does the FSA require that they still go back to 2001 if the test case is won or, if the case is not heard until 2008, will they only go back to 2002? If they only go back to 2002 then my complaint would be adversely affected. I am not sure whether it is worth going to court as the bank has also told me in the letter that if i do this they will ask the court for a stay until after the test case. Can someone give me some advise please. Thanks!0
