i have a claim with my credit card company (Monument) and I got a judgement order today saying it is pending due to test case, !!!!!!! I thought this only applied to bank charges, I called them and they said i have to write to them telling them, but they should know surely??!!
Who do I write to in the court and whioch section do I send to?0 -

I started Court action just prior to July 27th and Barclays have not replied to the court within the allowable time scale. I have been told by a court staff member that District Judge is placing Bank Charge cases on 'Stay', but said that there was no way of knowing what could happen if I proceeded with the case. What should I do ?0

Having never been hit by bank charges I'm concerned that all this is going to lead to the end of free banking. Hence many of the kind of people who are affected by this will probably not be able to even have a bank account.
Why should responsible bank customers subsidise the f3ckless ones who don't seem to have mastered basic arithmetic?0 -
I have been helping my friend reclaim over £20k from Lloyds and we didn't realise that the OFT had made the announcement in July, and so on 31st July we made a money claim online and it has been acknowledged by the bank's solicitors.
They have written now asking for full details of the claim, which we have sent them.
Does anyone know what is likely to happen next?
If the bank's solicitors don't ask, and want the case to be heard, should we ask the court to wait until the test case has been heard.
My friend is retired now, and is not at all well off financially. If the bank want the case heard away from our area, can we object?

Really hoping somebody can give us some advice. My boyfriend currently has a case going through the courts in Northern Ireland against the Bank of Scotland for almost £2000.00. The original response date for the case was 17th July and Bank of Scotland did nothing. Going by the advice on this site, we took that to be a "win" and requested a judgment by default. This was requested on 18th July and the case transfered on 24th July. Of course, since that date, the banks have announced the test case but, having read the emergency bulletin on this site, we thought this case would still be classed as a win and so, we would still get the money refunded.
Having heard nothing, we phoned the courts today to be told that all cases on the judge's desk, no matter what stage they are at, have now been put on hold until February 2008 at the earliest and so we will not be getting any refund.
Is this correct?
