Don't want to appear thick but can some-one help just received my letter from bank with all my charges dated 8th Aug 2007. Live in Scotland can I still claim for them back. Thanks0

I have had a letter from the court saying my case will be held until 20/08/2007 so the defendant can attempt to settle. this has not happened so what do i do next? I have called the bank they said call the solicitors. the solicitors just have a recorded message to write which i have done twice now and heard no responce. i have also phoned the court and thay said call the bank! i have explained that i am living on benefits but no one seems interested! HELP!!!0

I must have missed the whole thing about the test case (just had a baby!) so i applied to take Barclays to court in early August and now they have entered a defence and sent me a letter to say that they will be applying for a stay, not had a court date yet...but i got an offer from the bank june 11th, just over 2 months !, which i rejected via a letter - could i still go back to the bank and say i've changed my mind and stop the court case?? wish id done this earlier and dont really want to wait until maybe next year for the test case....help what should i do?0

When putting a temprory stay until the 20 August did the court make any provision for what was to happen when the stay finished? If they did not and the bank has made no attempt to settle this matter in the period of the stay write to the court explain that the matter was on stay to see if the mater could be settled it has not becuase the bank has not been responsive ( if this is the case). In the circumstances can the matter be listed for directions. At the same time you might want to consider saying that you are aware of the test case but you feel that this matter should not be stayed pending the test case. You can find reasons why it should not be stayed on a couple of threads on board.As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -

Once you have refused an offer you cannot later decide to accept itAs I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person0 -
The OFT + FSA should have left things as they were. People power was winning in the end and with the help of Martin and MSE they kept us right with the step by step procedures.
Surely common sense tells us that the banks have been ripping us off when they always bottled before the court date and mostly paid out in full - they know there charges are not fair and proportionate as the law requires.
Funny the OFT+FSA have advised all claims should be put on hold or stayed until the outcome of the test case but likewise did not advise banks to hold/stay any charges to accounts until the outcome of the test case!
So much for OFT being a consumer champion....... more a hinderance.
I hope this test case is given a fast track priority through the courts and when we win the banks instructed to refund automatically all unfair charges.
Somehow the law in the UK never appears to be on the consumer side or the victims but I do have faith justice will and should prevail.
I myself have received all my charges back from my two banks and sincerely urge you all to continue with your claims.0 -

I am following the MoneySavingExpert's procedure and following my first letter the Nationwide said "no go away" and said they would keep the file open for 56 days. I sent them a second letter giving them 14 days before I issued proceedings but have heard nothing since. Should I call them or issue proceedings? I am worried that they will close the file and am not sure what the implications are if they do so. Is this because of the group case going on at the moment?

I have recieved a letter with a court date set against Alliance and Leics for October. Will this still go ahead or will it now be defered? A&L haven't signed up to this thing.....YET!!!0

You should continue with the process and file using an N1 for at your local county court.0
