Yes, it's embarrassing to watch. I've not just watched it, didn't know it was on. Off to ITV+1 to watch it

    First one is two cousins:
1] Claiming for an iphone contract taken out and not paid.
2] Counter claim for wages paid into the other's bank account that she's not passed on.

    One's a druggie, of course.

    Housing one's just started.
Landlord - unpaid rent of over £4k
Tenant - where's my deposit + house unfit so had huge gas bill she wants covered.

£360/month, paid for from benefits for her + kid.

Tenant viewed it, needed a bit of TLC. No heating/hot water on the moving in day, couldn't get boiler to work, funny smell in the house (fusty). She gave a deposit and month's rent in advance.

Tenant paid the deposit and first month from her own pocket.
    LL said she received these.

Tenant tried to phone LL, no heating/hot water for a week. LL had boiler repaired. Tenant said "nobody paid for that". LL proved that she had paid for those repairs.

Tenant told boiler was not a long-term fix and boiler was in a state. LL was not told that - she just asked him to make it run and safe.

House was cold, ice on the inside of the house - so she got an external assessment done. LL said she hadn't heard of this complaint from the tenant.

Tenant bursts into tears giving her "think of the children" story. She said she complained over and over again, begging the LL to fix the windows. LL was shaking her head.

Tenant had occupational therapist report for youngest daughter, who has cerebral palsy and scoliosis. "Not a suitable residence due to the cold temperature..."

Judge - why didn't you move? "Because of what we'd been through there I didn't want another family going through what we've been through"

My opinion: odd attitude, I could accept if she'd said "on benefits, hard to find anywhere, can't afford new deposit etc, can't afford the removals van". She's playing some form of sympathy card. No idea if she's got a case yet or not.

Will continue typing in a bit - it's a commercial break now.

I imagine the LL gets very little out of this one. Having not seen this I imagine the tenant costs offset the rent and LL awarded £700ish?

    Tenant claim: £4058.53
    LL counter-claim: £4486.04 rent arrears

Tenant claims windows and doors were insuffiently fitted for the house to warm up. Rinder said she's under obligation to ensure windows/doors fitted so heat stays in. LL said this is the first time she's been made aware of issues with the windows/doors.

Boiler broke again, summer of 2013, it would turn off or cut out. Rinder asked her why she would stay in there the whole winter if it's not safe for her child etc, why didn't they leave. She said she'd taken up help from charities and children's centre and environmental health - she saw environmental health at the house, they sent a copy of that to the LL. LL said she did receive that report, doesn't have it with her. Rinder read out a report from a housing charity ".... gas capped because of potential carbon monoxide leak...." - the report advised the tenant what she should do next. Tenant then said carbon monoxide was the day they moved in. Rinder asked again - ".. could have killed you all... and you stayed here". Tenant said "Yeah, engineer fixed the boiler, he discovered the carbon monoxide, he said the only reason they'd not died was because she'd left the windows open to get rid of the funny smell".

Housing charity report said "... I repeat my advice to you that you must not stop paying rent you should ensure rents are paid in full and on time...."

Her claim is for return of her bond and the gas bill: Rinder looked at it. He said "you weren't smelting iron were you". 14 January to 7 February, 3 bed house, hot water and central £2978 for the month? She said it was a closing statement, so not just for one month. She lived there 18 months. Sep 2012 - Feb 2014.

He asked if she's queried that with them - they said yes it is. £175/month. She had a pre-payment meter put in, at her request. So £175/month on top of the payments she was making.

Rinder spoke to LL, she said she'd had tenants before, nobody'd ever complained of heating etc before. LL didn't hear from the tenant until August 2013 - she had received some benefits direct - who provided the statements/evidence of what she'd received. A spreadsheet from the council office. The rent is £360/month. Benefits is a bit less than that, so tenant has to do a top up. Tenant requested benefits to pay LL direct.

Rinder asked if she'd served them an eviction notice. LL said Yes. LL had given the tenant her deposit back in cash - and tenant said she'd then returned it to the LL once the boiler had been fixed. (I know this sounds a bit odd).
LL says she never received the deposit back from the tenant.

LL £4486.04 claim for unpaid rent.

Rinder says tenant can't prove what she'd have spent on gas, so has to ignore this claim.

Rinder said to LL, she'd paid 3 notices to quit, he will calculate the loss of rent up to the first notice. He said "... after that date you should have followed through and you didn't..."

    Amber awarded £0
    LL awarded £1467.60

ME: All a bit odd. Confusing to follow it really and see who was right/wrong etc. LL was odd too, barely said a word.
