So I would have had to refund her, then?
I feel like taking my business down the river!

it was covered earlier in this thread. With a SNAD claim you get the defect as soon as the case is open. With a return, even though the wording eBay give suggests item is faulty- you don't get a defect. However, with a return if you don't refund and escalate instead you then get a defect for each item.

If you follow through the refund option here

    http://ocsnext.ebay.co.uk/ocs/sc

You will see what eBay say which infers item is damaged or not as stated- even though the buyer has merely indicated that they want to return it.

The seller can then also opt to have buyer return it at their own cost.

Shame I did this the wrong way then. Is there any point at all in appealing the decision? Ironically just got this email from my supplier:

    Dear Customer,
Following your mail on the 13th of this month about the Headphones. We would like to inform you that in case of breakage the product does not fit on the warranty.

    Get our most sincere greetings.
    At your service.
    Cordially.

I never think there is any harm in appealing, if you have the time and energy you have nothing to lose.

I once had the most appalling foul mouthed buyer , bought an item from me and demanded a refund. When I refused to play ball she told me it had broken (this incidentally was solid cast metal) so I told her to send it back for a refund, she told me she had thrown it away- and this went in for a while. I complained to eBay and they told her she had to send it back for a refund, so she demanded I pay her courier fee to return it and eBay backed me when I told her to use MyHermes and sent just enough to cover it. When it came back it had been deliberately broken, it was laughable she must have taken it to a blacksmith shop to do so much damage to it and so neatly. She got her refund of course and I appealed - and eBay covered the refund themselves and refunded me.

So although buyer 'won' and she truly was a nasty piece of work, I got a single defect, no bad feedback (eBay removed it) and my money back.

Just lost the appeal as well, although as a gesture of goodwill Ebay have refunded the FVF. Thanks guys!
Apparently I did not have to accept the return request.
