Problem with Ebay sale - buyer broke 2 items!

            I did phone Ebay this morning and said I was not happy to receive broken headphones back, the rep was very sympathetic however he said it was a grey area and looking at it impartially he could not say that either I or the buyer is in the right.
 He did say that one of my options was to tough it out and let the buyer escalate as I already have a defect from the request anyway - but he said I would probably lose. I suppose I run the risk of irritating the buyer further and incurring a neg/low DSR.
 Or I can simply refund and forget about it, after all we are only talking around £30.
 Or I can ask for a return of the item prior to refund, but then I will have 2 broken pairs of headphones - not much use really, it simply buys me more time...0

            EBay is really screwing sellers at the moment. We seem to be wasting more and more time on phone trying to sort eBay glitches and trying (and failing) to defend ourselves from dishonest buyers.0

 Last thing that sold was to someone miles away. paid by bank transfer and sent their own courier.
 Good thing about Gumtree, other than being free (for now), is that you don't have to jump through all the hoops ebay/paypal make you do.
 In fact just this minute someone from Gumtree landed from 70 miles away and bought something."Love you Dave Brooker! x"

            there is not much you can do. the rep is correct you just have to wait it out or roll over. its not a grey area its very black and white. you are getting turned over.0

            you need then back as how do you know they have actually BROKEN then. They could have disconnected bits and sent pics so looks like they are broken, so you refund without getting them back and all they do is connect the bits back again and have your headphones and the money .
 If they are genuine then i dare say they will have no issues in returning them to you.0

 Yes user damages according to buyer, but just like Paypal, Ebay work in aid of buyers, so even if a buyer breaks something, they just tell ebay its faulty and ebay will force you to refund, but first the buyer has to return the goods, but then when you get them back you can then inform ebay they are user damaged.0
