no because if you can prove to ebay they are user damaged then you dont need to refund.

Have them back then you can either use them as spare parts / packaging for others that get returned (Assuming your wholesaler won't have them back) or get more broken damaged ones together and 'joblot' them at a later date as a 'Spares and Repairs' lot.

No my wholesaler won't have them back - and the buyer no longer has the packaging. Not sure I want to sell these anymore now anyway.
I have until 18th to respond to the 'request' - I will ask her to send them back and take a look at the point of breakage.

I have gone through this personally and won and not had to issue a refund. Dont forget Ebay is not the law and if you can prove user damage then no matter what ebay have in their terms the LAW will always override these. Sometimes Ebay just needs to be reminded of this

I will try but not holding much hope, I need to see the headphones and see where the break is, if it is in different places it may help. I will phone anyway, no harm in trying!
Ebay make enough from me in fees to make a little concession now and then - december invoice was just over £1400!
  • Just been talking to live chat about the item my buyer is wanting a refund for as it is broken. There is a 'request' open.

Ebay chat say "Please note that when you accepted the buyer's request to return the item for whatever reason they had, you are obliged to issue a refund once you received the item"

Ebay chat say that my only options would be to escalate the case or refund, I can't accept a return of the items just to inspect them to check where/how they are broken.

I don't suppose Ebay will side with me if I escalate.

Probably best kept in your existing thread as all the info is already there.
