The Decision to pay the claim will be made by your insurance company, no amount of jumping up and down will change anything.
You can sue who you like, it's a free country.
They will look at the claim and make a decision based upon that, they do also look at economics of fighting as opposed paying, thats why they are in business.
If claims were denied just because people rant they were not involved there would be no point to having insurance.
Calm down, enjoy Christmas and let the insurance company worry about the claim, its what you pay it for.I do Contracts, all day every day.0 -

Of course an insurer can choose to pay off a claimant in these circumstances but FOS would normally take the view that if it then disadvantages the policyholder over a non-existent claim this would be a breach of Principles 6 and 8.
Absolutely.
The OP says he intends to go to court but a court will then ask if he has acted reasonably and he risks it concluding that he has overreacted to an innocent mistake.
It might through the case out. Or it might make an award of as little as a penny - far less than the case cost the OP to bring.

do you really relay on someone else to resolving your problems in your life? If yes that's very sad. I'm not that kind man which sits on a sofa, eating chicken and chips - hoping that all problems will go away without doing something about it or hoping that my problems will resolve someone else. This is bad idea i think. This not about money, if i will go to court, some one will have to pay price for it and pay price for making mistakes. This is not overreacting i would class it as self defence sheet in this case.
Is it that difficult to understand, if someone using cloned reg plate had car accident..if other driver had idea how to deal with in correct way when collecting all information..it would be much more less such misunderstandings in real life as it is now - today. It would be much better to live for all of us. Maybe it would be much more easier to deal with your car insurer in any case..
this is nor overreacting, i'm !!!!ed off a little bit, because someone incompetent at what they do..yes, that's right, normal people call it incompetent.

I will give you free of charge advice: if someone asking you to do something..if it is possible to do it even better then someone asking and if it is benefits you - do better then someone expect you to do it. I think you will catch my point here.0 -

If the other party has made a statement to their insurance saying a red car with reg xxxx xxx hit me and your car is green trust me it WILL go away that easily unless as I suspect you mean you wont let it go which to be honest has me perplexed as a lot of what youve written is about the stress its causing you. If it was a simple mistake your going to go through far more stress trying to convince a judge to punish someone who made that mistake. In the aftermath of an accident its more than understandable to get a digit wrong especially if the offending car speeds off0 -

This is all information which I own from my insurer: my reg plate involved, but on different name and address..so this is means that drivers exchanged details..this is means that claimant had more then enough time to deal with it.
Some people judging me here..How i can trust my insurer if they still didn't provided any information regarding all this..? I can't relay on them all way to 100% can i? All we people, all we have problems..all off us have bad days at work..i don't want to be that man which can be caught on someones "no mode today" or "i cant be asked to do it properly" .
This is real life. I don't wear pink sun glasses.. You can relay just on yourself or on someone who is really close to you..
who is my insurer to me? empty space - we have business going on, that's it...
I won't leave any chance to them, to deal with it incorrectly. I have to make sure that everything goes smooth as much as possible.
And when i will have all facts in my hand then i will decide what to do with it.
My insurer coming to inspect my car..my question is - what they will look for if they don't know what sort off damaged been done in a first place..? or option B - they know what damage been but they do not provide any information which i requested on legal grounds..get in my shoes before judging me people. Feels that they working other way around. In my opinion..get facts from third party then you can disturb people with inspections and stuff like that..i don't like all this thing if be honest. Like i said i feel that i have convince my insurer that i wasn't involved in this accident..i don't feel that my insurance working 100% on for my interest.0 -
So to confirm your insurer has been informed from the other insurance company and they have said that the other party noted your registration details and took the name and address of the driver (not your name/address) This really does sound like a simple error with registration plate just point out your name/address isnt the same as that the driver gave and that you don't know anyone with that name (assuming you dont) other insurance then just send letter to name and address and issue sorted (assuming they reply which having swapped details they most likely will)
Hopefully the make/model & colour will even be different to your car0 -

They have number plate which exactly as mine..before proceeding with everything..it much more easier to double check with third party, what car it was, model, color..match it up and take it from there, simple as that...that's way i don't have a peace at the moment because i don't like which way my insurer deals with it..I don't have any sort off experience regarding car's accidents claims..not sure which way they deal i'm talking about insurers inside jobs. And if number plate matches for sure..let's say my insurer will close claim on my behalf..so that's it? What about provided cloned reg plate at incident? What i should do about it? Insurer they don't care about such things..and if i don't any have information on this..how i will report police that there is cloned reg plates somewhere out there..i know they just will move on leaving me behind with all this.0 -

If someone driven off with my number plates on a car or with similar number plate..that's might explain why i never been provided with any details because no one has anything they simple don't have anything for real..and they lie to me regarding different address and name..so if it is this case, they suspect me in this accident and that's why i feel that i have to convince my insurer that i wasn't involved there..and they trying to catch a wrong fish here) that's all makes sense now. But i think this is not very correct way to deal with it i think should be police already involved in it and police should be dealing with this drive off thing..not having any real evidence and back stabbing me in such way..if it's a real deal i think my insurer a bit out off a line here in terms of law and in terms on human level.

Didnt you say they had you registration number and a name/address of the driver ? in which case they must have exchanged details how else could they have a name/address ? soon as they contact the driver he should be able to give them his correct registration.
There really isnt anything else to say until you get more details of the accident why you dont just call the company that sent you the letter I really dont know.
Im even starting to think this is a wind up now0
