What does this have to do with this thread? The OP hasn't said that she won't move out. She came here for advice so she can weigh up her options. I don't see anything from the OP that indicates that she's shocked that she will have to eventually move.
Yes the LL can gain possession of the property if the proper channels are followed but as we established many pages ago he hasn't followed the proper channels. If the OP decides to go for social housing then the council could hold out for an eviction order which he won't be granted because he can't get his paperwork right which will slow down things for both himself and the OP.0 -
Re morals - are you saying I should NOT be kind to my tenants? I don't understand!! Obviously I've got to protect myself financially but I still like to be able to sleep at night!!
And yes, I AM sad that my morals seem to alien to you lot. Ie "treat your neighbour (lol!) as you would yourself".
Your morals are that tenants, with legal rights to reside, are doing something wrong by living in a property. Another useful post...Guest - may I respectfully point out that "Accidental Landlord" is shorthand jargon in the housing industry for someone who didn't buy a property in order to let it for a profit but who "ended up" as a LL through circumstance.
Did you genuinely think I was being literal that I had an accident?!

I'm aware of the terminology, I don't agree with it. It is used too often to suggest that the LL is an innocent party because they weren't planning on being a LL, so the regulations are too hard on them.
The correct term is simple 'land lord', doesn't matter how it happened. You choose to run a business, you learn the law.
As for tenants changing locks.... If my LL came in whenever they wanted ( as you suggest you do) I'd change the locks. You have no right to do so.0 -

Tenants are only doing something morally wrong according to your set of morals. The laws of the land in England & Wales are quite clear:
- An AST can only be ended by the tenant or a court.
- A Section 21 does not end a tenancy.
If you don't like those laws then write to your MP.
I think that it's morally wrong to come wading into a thread and being horrible to the OP accusing her of being an "entitled tenant" when the OP is a woman who has survived an abusive a relationship, is now a single mother, is working 2 jobs and studying, whilst you, a single, supposedly professional adult with no dependants cannot manage your own finances without financial support from you parents. However, I also believe in free speech which is why you're able to join the thread spouting your bile and offering no support or advice to the OP.0 -
It's tough if you don't like the phrase - "accidental" LL means - I didn't originally buy it to make a profit. It doesn't mean I shirk my responsibilities. Maybe you don't like the phrase because it shows not all LLs set out to screw over poor hapless tenants. Maybe even some LLs are in WORSE position then tenants - can't sell their property or have lost their jobs. But that doesn't suit your politics!
Anyway, I'm afraid the phrase is well established now or perhaps you would like to write to the Independent and various other newspapers who have run articles using that phrase. Perhaps also tell Martin Lewis that you disagree with it.
Tenants ARE doing something morally wrong when they stay after being given 2 months notice (or whatever period stated in agreement). Not fair to make LL have to take them to court. And yes, I would characterise it as akin to criminal squatting.
If a tenant served a notice which hadn't, eg, been signed or dated or had some "technical" problem, no way would you advise them to stay and pay rent, especially if the LL had stayed quiet and taken advantage of their error!
It's dishonest behaviour and you know it. The problem is with entitled tenants who think the world owes them (and their kids!) a living.
And no, I don't go in "whenever I want". I go in to water the plants if they're on holiday! With permission! As I said!
I don't know what has given you such a chip on your shoulder. Some tenants and LLs have a mutually beneficial, respectful and trusting relationship!

The law is very clear.
If a LL wants to end a tenancy they need to serve a s21 notice and attend court. That is the law. It's not moral. It's not dishonest. If you choose to be a LL, then you should know this from the start.
If a tenant wants to leave. A tenant serves notice and may leave. That is also the law.
If the tenant serves notice wrongly, they are liable for the rent. Obviously.
You're the one with a chip on your shoulder, that tenants have rights. They should be grateful for having a place to live... Squatters... That about sum it up?0 -

Thanks everyone who gave me advice and taught me the law.
I am taking a break from this issue now.
Someone called me from Shelter and I unfortunately missed the call. She left a voice mail saying that will call me again from the 5th. There is no way to contact this particular person and I hope I manage to catch her call next time.
