It always baffles me how some people seem genuinely shocked they can't stay in their rented property forever unless they choose to move out - at the end of the day someone else does still own the house, and if they need it they're entitled to it back providing the proper channels are followed.
For the record, I rent privately too. It's just a risk you have to take.0 -
My reference to "accidental" was to explain that, in any event, my aim in becoming a LL was not to make a profit but to maintain my flexibility ie my ability to move home if I need to.
Serious Q tho - what is the problem with using that term? I thought it just described that the LL was not of the traditional, profit-orientated kind? But I always get a kicking when I use the term, even tho I learned it on here I think!!
No - I never "accidentally" used a Letting Agency - I sourced my tenants privately. I did, however, do all the other things - gas checks, insurance, registration as LL. So my saying I am an "accidental" LL does not mean I shirk my responsibilities.
In actual fact, although LEGALLY I could have had my tenants evicted by now, I am letting them stay til Summer because they're moving abroad then anyway hence I'm staying with family. No point in them moving twice in a short space of time. That's the MORAL thing to do. I would expect them to treat me fairly as well, if a situation arose. Which they have always done - eg they insisted on paying a contribution towards the communal garden grass-cutting bill this year even though it's not on the tenancy agreement as their responsibility. In return, I will store some of their stuff for them while they are abroad.
Consider me a b!tch or an idiot if you want. That won't make it true though! ;-)
Serious answer: accidental implies it was not a conscious decision. The fact is you are a LL, just like any other. Profit or not.
All the legal regulations apply just the same. Which you know. Your morals are nothing to do with it.
You choose to store their stuff, that's your choice. You choose to not evict, again your choice. - though even if you served notice today, it would take you 3-4 months to actually evict.
Basically the problem is- this is a business, your morals have no place in business. But you shout them off as though everyone else is terrible for not agreeing with you. You are in the minority though.0 -
Anyhow, shame I'm to be ignored again - I have quite enjoyed the debate.
Sorry for derailing your thread, OP. Do the right thing with your LL - come to a mutually acceptable agreement. Karma's a b!tch :-)

Guest - may I respectfully point out that "Accidental Landlord" is shorthand jargon in the housing industry for someone who didn't buy a property in order to let it for a profit but who "ended up" as a LL through circumstance.
Did you genuinely think I was being literal that I had an accident?!
Do we really need to write the exact circumstances in full every time to avoid confusing you?

If you have savings at the bank of mum & dad why did you have to borrow £10k from them to pay off some of your other debts? Where are these savings that "some of us" have?
I mean, my mortgage lender will be quick enough to take me to court and have me out if I default but Tenants seem to think they should have more rights than a homeowner.
If you default on your mortgage it would take months for your lender yo go to court just the same as it takes a LL months to go to court when a T falls into arrears. I'm no fan of Ts who don't pay their rent and I do have some sympathy for LLs who end up with such Ts.0
