But the council are not responsible for the responsive law on traffic matters
As an example (and I'm not suggesting this happened but it's for context)
Police Officer is passing and notices traffic is queueing to get past a vehicle causing an 'obstruction' and the following conversation ensues
PC - You're causing an obstruction - would you mind moving your vehicle
Driver - I've a Blue Badge and I can park here
PC - but at this moment you're causing an obstruction and I'd like you to move please
Driver - but Council have said I'm ok to park here
PC - but right this minute in my opinion you are causing an obstruction - please either move your vehicle or I will arrange for it to be removed
ah you were one of the people listening in, thats pretty much how the conversation went. there were 3 lanes of one way traffic and where i was parked was were lorries park to unload but he said that they can and he wasn't interested in the times allowed for bb parking (he got the time wrong)0 -
In my opinion (as a blue badge holder myself), the blue badge doesn't confer any right to park on yellow lines. It certainly isn't correct to park in a place where you are likely to impede the normal flow of traffic.
As a matter of interest, you say you were parked, but presumably you were sitting in the vehicle when the police stopped and asked you to move? Were you - by any chance - waiting for an able-bodied person to return to the car? If so, maybe you could have parked further away, or driven around the block to avoid obstructing other traffic ?
I consider the parking help my blue badge confers on me to be hugely useful, but I try to be as considerate as I can to other road users when I use it.I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say.0 -
Were you prosecuted, or are you awaiting prosecution under Regulation 103 Road Vehicles [Construction and Use]Regulations 1986 and [causing or permitting a vehicle to stand on a road so as to cause an unnecessary obstruction] ?
A police office can ask or tell you to move regardless of BB or yellow lines or even no yellow lines, not so doing can also mean you are obstructing an officer exercising his powers !Disclaimer : Everything I write on this forum is my opinion. In that case what did the police officer say when the council official told him you were not causing an obstruction.0 -
So there was someone from the council there as well?

There was no one from the council there but there was a parking warden there who said I was perfectly allowed to park there in the eyes of the council.0 -
when we reported it to the council they said that they had done a risk assessment done and they deem that between certain time they do not allow parking as may be deemed as a obstruction.0

Can a police officer tell you to move when you are parked on a single yellow line. Displaying a BB within the correct time for Parking. And say if you don't move I will have your car removed even if it is a mobility car.
Yes of course he can !
Look ............
- who is the BB holder, the passenger [who is not in the car] or the driver who is waiting for someone [who is not mobility impaired] ?
- what were you reasonable reasons for refusing to move, being a BB holder in a permitted area is not enough reason !
- whilst the general public and public servants should respect the rights of BB holders !
- I'm not clear on what grounds you thought a policeman asking you to move was unreasonable !
You give a very selective set of information to this forum, making it difficult to decide if you were bellicose and should perhaps have your badge revoked or suspended for 13 or 26 weeks by your BB authority.
or ................
Be prosecuted, under Regulation 103 Road Vehicles [Construction and Use]Regulations 1986 and [causing or permitting a vehicle to stand on a road so as to cause an unnecessary obstruction] ?

You know its up to BB users to make very sure they themselves avoid bringing a blue badge into disrepute, its a huge privilege that many millions can not manage without.Disclaimer : Everything I write on this forum is my opinion. In Oldham near where I live, BB holders can currently park in loading bays.
There is currently a review taking place that will when complete provide a nationwide resolution as to whether Loading Bays should be available for BB holders to use.
Whilst this process is ongoing Oldham council are allowing the use of Loading Bays for BB holders to use.
They do not advertise this on their website, but the following is from an email I received from them;Ordinarily blue badge holders are not entitled to park in loading bays as stated within the booklet forwarded with your badge however currently there is an enforcement issue being sorted out and so the information provided to you was correct at the time. Parking in loading bays will be allowed up until this matter is finalised however the Parking wardens are unable to advise at this moment how long this will be the case so it is recommended that you ask a warden before parking in a loading bay to ensure that a ticket isn't issued.[SIZE=-1]To equate judgement and wisdom with occupation is at best . . . insulting.
