    I think the post above yours explains it. We are awaiting the Supreme Court(formerly the House of Lords) decision as to whether the charges can be assessed for fairness.

    The next decision is whether the charges are assessable for fairness and so we haven't started the real nitty gritty of which terms are unfair, if they are unfair what is a fair term, how far back does the bank have to refund and what method they have to refund by.

  • I think the best solution to this problem (like everybody did with reclaiming in the first place) is to take your money out of your bank accounts and refuse to pay any money in until you are refunded your charges money.

    They will be losing absolute fortunes if everyone pulls together and acts on this.

  • My daughter who works for HBOS informs me that the banks have been told that the Law Lords will deliver their verdict on bank charges next Wednesday (21st).
    She has told me in the past that she thinks the Law Lords will rule in favour of the OFT but that banks will not be forced to repay charges. She still believes this to be the case although she has no evidence to support her theory.
    We wait with baited breath.

    Your daughter is wrong. The Supreme Court posts its upcoming cases each Thursday for the following week and as has been mentioned on this thread it will not be until at least October 26th.
    However, she is 100% in that the Law Lords decision will not force the banks to repay even 1p since this part of the case is about whether the charges can be assessed for fairness and NOT if the charges are fair. Out of interest, does she work in a branch, head office or their legal department. If it is their legal department please can you PM me rather than say it on the open forum. I have seen issues where the department is that small that it allows identification of the individual which can cause problems.
