just like to know where to go now I claimed £1700 from the halifax about 6 months after going on a payment plan with my creditors. The bank accepted I was in financial hardship and offered me £85 pound. I then went to the Ombudsman and even though he agrees I am in financial hardship the adjudicator says he is 'persuaded' the bank have done enough under the banking code of practise and does not think my case should go forward. I of course disagree but have to reply to hm by the 2nd september, any suggestions.

Did you receive a final response from the bank?
What did the final response say since it should include their reasoning behind the decision?
Do you have priority debt arrears not being paid off?

Claim to the bank or the County Court?
If it's to the bank then simply write another letter quoting any reference you may have had been given and send them an amended list.

Bizarre it may be but i received two letters from RBS today after not hearing anything for months, one saying that they believe the charges are fair, transparent and lawful however will deal with my complaint as quickly as possible once the case between the OFT and the banks finish. The second letter has a customer financial statement which they want filled in as they sent me one a number of weeks ago but have not received my response. I did mention hardship to them months ago but did not receive any sort of communication back from them. Hopefully things are on the move now

  • Hi, I have only just got round to sending off the very first letter requesting how much I have paid in charges for going over the overdraft etc.

I have 2 accounts, one with Abbey (never had a charge from them) and Nat West (had a good few charges from them) so would Nat west close my account after I request the unlawful charges back? I also have a big overdraft with them that I cannot afford to pay back right now all at once - so is it even worth me asking for the charges back?
Lastly, would Nat West 'talk' to Abbey and therefore Abbey would close my other bank account?

Neither bank will talk to each other and neither bank can close the account simply because you claim he charges back.
Do you have priority debt arrears(mortgage/rent, council tax, utilities)?

  • Thanks for the reply :)

Yes I have a Mortgage, Council Tax etc. I also have a Credit Card with my bank that I owe about £6000 on (I currently pay £350 per month off that too) - would they cancel my overdraft and credit card if I ask them to pay me my charges back?

No they won't cancel the overdraft or the credit card.
If you have arrears on the Mortgage and council tax then which account does it come out of since if I was hedging bets I would tackle the account where the main debts come out of and subsequently should be where the most charges have come from?
