  • ok so i successfully managed to reclaim my charges a few years ago from HSBC. I found them very helpful and pretty much gave me exactly what I had asked for. I have terrible credit (due to being very foolish when I hit 18) but I thought I'd got myself back on my feet again.

    I now have a HSBC Plus Account, but due to recent issues I have gone overdrawn a few times and they keep letting me do it and keep charging me through the !!!!! for the "privilege". I don't know what to do as I seem to be getting more and more bogged down in it and they keep charging me! I don't know if I can reclaim my charges again as I have already done so, but they already taken about £300 off me in 3 months for "informal overdraft arrangement fees". :silenced:
  • Ive just spent an hour or so on the phone with HSBC which, without tempting fate, was quite a positive conversation centered around my financial difficulty. Although my missus asked me a question which i dont know the answer to....."if we get the money but the banks win the court case can they take it back????" :confused::confused: Any ideas?

    They won't take it back.

  • Filled in income and expenditure for HSBC and waiting.

    This year i have paid 2 x £25.00 and 1x £11.00 and also in August a £100.00 charge in bank charges. Seems that they just pick numbers out of thin air. ;-(

    I was under the impression that I couldnt claim any money back from abbey as they had changed the way they charge customers. As it is now a sliding scale charge I didnt think this would count as a penalty charge.

    I am on benefits and they have left me on numerous occasions with very little to live on. If I can claim do I just go through the template procedure.

    You can reclaim charges even if they have changed how much they charge you.
    Time to start the process ;)

  • Hi all, I have applied to Lloydstsb for my charges, recieved a letter the other day that just went on about the test case, But I am claiming due to Hardship ( I have a DMP with CCCs). I watched Martin on GMTV the other week and I am sure he said they still have to look at hardship cases regardless of the test case waiver

    I have spoken to them on the phone and they say that they dont have to do anything until the test case is over,

    So I have looked on here and on FSA site but I cant find anything up to date that clearly says that hardship cases are still to be looked at regardless ofthe test case,

    So are they right ? Does the the waiver that allows them to do nothing until the test case is over apply to hardship? or do they still have to look at my case??

    I hope Martin didn;t use the words "regardless of the Waiver" because it is part of the waiver that banks should look at cases of financial hardship

    FSA waiver on Bank charges is on my signature which says what they have to do and what they don't have to do.

    OK, well, I have read it and although it does say how they must deal with hardship cases, ie not closing accounts,being sympathetic etc, I still cant see where it clearly says if hardship is covered by the waiver and if they have to look at the claim straight away???

    Its prob just me not understanding it correctly...

    Lloyds told me that the waiver means that they dont have to do anything about claims ( whether its hardship or unfair) until the test case was over..

    I know they dont have to do repay a penny, I am just trying to understand the waiver so that I can argue my case.
