Do you have any priority debt arrears(mortgage/rent, council tax, utilities)?0 -
I put it through county court and the bank applied for a stay and bank sent me a letter telling me that they wont make a decision til basically they are forced to by the oft case. I have no arrears but would like the money to help for wedding as there are things we cant buy that we would like to. I started the process in 2007 but it was slightly too late as banks stopped paying people out. I bank with NATIONWIDE if hat helps any.
Am I right in thinking if they are paying people out in financial hardship cases that is an admission that they are at fault. I cant see any other reason for them paying out.0 -

You are totally wrong, Banks are paying out on the basis that a lifestyle issue for example loss of employment and subsequently the loss of income has caused charges and that those charges have meant that people are unable to meet their basic outgoing like priority debts. So in reality "Serious Financial hardship", not skint, not a little brassic but in serious financial hardship which might cause them to be living on the streets or in a tent.
Apologies, but with no arrears the court will stay the claim and its a wait and see. If you get more charges then the process begins again.0 -
Cheers not what I wanted to hear ha but glad somebody could clear it up for me like I said im no brainbox, thanks again and good luck to everyone reclaiming.0

Yes agree £90.00 is over the top. A charge of some value proportionate to the amount overdrawn should have been applied.0 -

just like to know where to go now I claimed £1700 from the halifax about 6 months after going on a payment plan with my creditors. The bank accepted I was in financial hardship and offered me £85 pound. I then went to the Ombudsman and even though he agrees I am in financial hardship the adjudicator says he is 'persuaded' the bank have done enough under the banking code of practise and does not think my case should go forward. I of course disagree but have to reply to hm by the 2nd september, any suggestions.0
