    That is very poor advice there. The OP may have been in financial hardship so perhaps negotiating a higher payout on the basis of arrears might be a good suggestion. Saying take it away, its not the full amount leave the OP with no money, financial hardship and a claim stayed at court. That doesn't help the OP does it?
    No banks can settle claims as Full and Final Settlements.

    Result!

    After jumping through a few hoops i finally managed to speak to an actual human at Nat West who was handling my financial hardship claim. I sent the form off in early march and was calling to find out why i hadnt heard anything. She gave me the direct number of the people it had been passed to - the OFT team (woo woo) so i called them up and spoke to another real life human who said if i faxed her a few examples of my 'hardship' she would make a decision in the same day and call me back. The decision was positive and she said i will be receiving a letter with an offer in the next day or two. I've claimed for about 3K so fingers crossed!!!

    Can you post the telephone number and fax number on the forum? Fingers crossed that they clear your arrears. If not negotiate.

    Attended court yesterday for removal of stay against Alliance and Leicester to reclaim bank charges. Judge threw it out of court and awarded costs to the defendant.
    What will these costs be?
    Why did he throw it out on grounds of hardship when our income is £1267.00 per month, our monthly outgoings are £3231.00 and our debts are £255,916.00?

    What grounds did you ask for the case to be set aside?
    Who suggested/advised you to try and get the stay set aside?
    What bank is it? Have you gone back to the bank?

    I was given a court date of 14th August 2007 - just after the 'stay' was announced. What will happen when the outcome has been decided? Will I be given another date and is it essential that I attend the hearing?

    Firstly I would check to make sure you have an unlimited date stay, ie until the OFT test case is over. With regards to the other questions, I think we will know soon so keep your eyes on MSE for updates.

    I am still trying to reclaim back the £957 I was charged from TSB in less that 2 years. I have been trying to claim this back since early 2007.

    Im now trying to claim back through a company "My claims expert" and they say it could take a while as TSB really dont want to pay back any money. Apparently other banks are actually paying out partial payments back, but just not TSB.

    Has anyone successfully managed to reclaim anything from TSB?

    It depends how hard the CMC is really trying and whether they are asking for your claim to be looked at as financial hardship. Do you have priority debt arrears(mortgage/rent, council tax utilities)?
