Bank Charges Test Case Article discussion

    I think the test case thing in the house of lords starts today and is scheduled to last for three days, am I right? What will happen if the outcome isn't in our favor? Wont we get our charges back?

    You're correct, the banks appeal against the decision that charges are 'subject to fairness rules' is due to start today and last 3 days.

    Hopefully this will be the last way that the banks can drag it out, as it's gone on FAR to long.

    Once the appeal fails I believe it's over to the OFT to say whether it thinks bank charges are unfair.

    Sorry if I have got anything wrong, but that's what I think is going on.

    Fairly good summary as to how I see it. One difference being that the OFT would have to identify terms which is believes are unfair and ask for voluntary compliance(yeah, right!) otherwise we have new litigation on the specific fairness of a term or terms.

    Right I see. Thanks everyone, it's a bit clearer to me me now. So what do we think the out come will be? I know what I'm hoping for!

    Do send an updated list of your charges. Add a separate column if you are claiming interest, plus a description of each charge. Don't trust the bank to do this for you. Remember to post it recorded delivery.

    thanks for that. wont need to send registered as i work for a courier company and my bank are one of our clients :rotfl:

    Since it was the OFT who set up these court cases and suggested all charges were unfair in the first place, i believe they will say the charges ARE unfair and i think we the customers will win.

    Then again, will the banks start to drag out their time again with paying people? Who knows, or maybe they will find another loophole in the law and appeal again for another few years, this would be a nightmare.

    There isn't another loophole, cos UTCCR 1999 is pretty good. I have been reading the summaries from the Legal Beagles site(non journalistic as well). I am not sure the Law Lords are buying the banks verbal arguments.

    Thats good news then! When we all likely to know the results of this case do you reckon? If its pretty soon, i will drop all my hardship claims and just wait for the payout.
