    Make sure the bank is updated with your address since they will need that when the test case ends. Unless you are in financial hardship then there is no escalation process if you are moving abroad.

    I sent the first letter to Cahoot last year and got the standard letter re waiting for the test case etc. I've had charges applied since this letter, do I need to write again updating my claim or should I just wait fot the green light once the legal side is sorted out ?
  • I spoke to the Judicial Office this morning who told me the Banks' had filed their petition to appeal on 6th April 2009 and the case is awaiting listing. There has been a discrepancy in the information that was given to somebody else from that office so will clarify it but banks' have filed their petition in writing on time.

  • Interesting development?

    A payment has just appeared out of nowhere on my Barclays current account. It lists the payer as: "Goodwill Gesture Preston Fishergate" and the payment amounts to my original bank charges claim minus the interest. A quick Google confirms that Barclays do, indeed, have offices at Fishergate in Preston. I have had no letter or other communication about this.

    Should I accept this or query the interest?

    I was making a bank charge claim for several thousand but was told by Lloyds TSB that because I was declared bankrupt in 2006 (time now over and out of bankruptcy) that any money that I now receive would go straight to the Receiver to pay off my creditors. Is the correct? I'm even more hard up now and could really do with the money. And then if i can claim, can I claim back from the time that I first placed my letter and templated letters? Thanks for any help!;)

    Have you been discharged or not? Were the charges incurred up to the date of bankruptcy and are from accounts that formed part of the bankruptcy?
    If the answer is yes then they are indeed 100% correct.

    You have just got a Barclays payout. They do seem to be paying out at the moment.

    The HoL have moved the case one day to 23rd June 2009 for the appeal.

    Send a letter to this office (recorded delivery of course) accepting their most king generous part payment offer but stipulate in your letter it isnt the full amount you were seeking and give them a further timelimit to reimburse by or county court will follow.

    Go for it, keep it going. ;)
    If you see a penny, pick it up, all day long you'll have good luck !!!!!! :D

    It would be futile to pursue the interest in court as the case would inevitably be stayed pending the outcome of the test case.
