the answer is yesRalph_Newbie_Claimer wrote: »Does anyone know if the charges can be recovered from a personal business account? I was a sole trader and was charged over £300 in 2 months for going over overdraft, purely due to unpaid item fees. Have written to HSBc and they are unwilling to pay anything.
I realise it is in appeal to House of Lords. Was just the theory I was wondering about. Thanks. This has been so useful.0 -
Yes you can.charlie0209 wrote: »I successfully claimed over £3000 from Halifax bank back in early 2007 but have since then incurred anumber of charges on the same account.
I want to try and reclaim these but am unsure if I can given my previous claim.
Can anyone shed any light on it for me?

If you look at the letters on financial hardship, they have been adapted to fit. The criteria of "discontinuation of regular credits" is one aspect to financial hardship. If you have arrears then it is, dare I say this, more likely they will make some form of offer.Hiya,
My case is on hold due to the test case but having been made redundant in November 2008 i am intending to ask them to look at it now due to "discontinuation of regular credits"
I just wondered if there was a letter for this rather than the original 2 letters which i sent ages ago.
I have looked but couldnt find anything. If it helps its for HSBC.
1 last thing, when i originally requested charges back i didnt request and interest or "inconvience", whats the thought on this, just go for the straight refund and leave the rest alone? push for max? personal choice?
Thanks in advance0 -
My bank has recently started charging me £5.00 per day for being over my overdraft limit. Will I be allowed to claim back these charges as well as the normal bank charges?0

Hello everybody. Having had a small claims case on hold since right back in July 2007 I'm looking forward to having this whole thing sorted once and for all but what I want to know is (if of course the final decision falls on the side of the consumer) will we be able to claim an extra 2 years statutory interest? My claim is already in for a certain amount but will I be able to change this without dropping the existing case and raising another?0

You are fine. You're claim is getting interest while it is stayed.Dan_Bailey wrote: »Hello everybody. i dont know if this is a daft question or not, but run with me here!
lets assume you made a claim for bank charges 1 year ago, worked out & included the interest, lets say for round figures £200 of charges & £50 interest
now 12 months down the line, the charges are still what they were, £200, but if you were claiming today, the interest would be, say, £75 due to the time ellapsed
if the bank ends up returning your cash including the interest, would you end up with the original claim amount or have the opportunity to say 'hold on, i'd like to re-calculate this'
if, as in the example above, you were only talking £25 and the bank said take it or leave it, i know what i'd do, but what of the people who are talking about £1000's in charges??
discuss!! :beer:0 -

If the banks lose then they have to compensate you for depriving you of your money.0
