    Hi.
    First post here so be easy.

    I moved in to my new house about a year ago and advised my creditors of change of address. New Look failed to action this and sent all my statements to my previous address. I completely forgot about this until recently and contacted New Look.

    They advised me that because no payment has been received I was charged £20 a month in late payment fees. This took me over my agreed limit and was also being charged £30 for this. So a bill of £30 has now become £260.

    I asked for copies of my statements to be sent out and they said it would cost me £6 per statement. Is this correct? Also, am I entitled to argue the fact that these charges are illegal? Can I request under the Freedom on Information Act, the actual costs incurred for going over my agreed limit/late payments?

    No under the Data Protection Act an |SAR costs amaximum of £10
    Also, am I entitled to argue the fact that these charges are illegal?
    Yes

    No, they are not a public/government organisation . FOI doesn't apply to them

    can anyone tell me if i can claim bank charges back !
    i have an advantage gold account with nat west. i pay a monthly fee which gives me an overdraft facility. although not yet gone through this limit i do get charged bank charges as well ( on monthly basis)
    can i claim these back ????????/:confused:

    Someone's jumping the gun a bit.

    Bankcharges are not illegal at this point in time, they are (presumed) unlawful and unfair, but that has not been decided (yet).

    You might be talking about interest here. Unless the overdraft is 'interest-free',
    any monies used will occur interest, at the rate specified in your account.

    If your interest rate is 16% and you are £500 overdrawn, that will cost you about 22 pence per day.

    You cannot claim that back.

    It has not been decided the the charges are unfair, only that the OFT have the power to decide if they are.

    Start your court claim now. Even if it is stayed, it means you don't loose out on the six year limitation rule and also should speed up the process of any refund.

    hope you could give me one more piece of advice as you seem to be very clued up .....
    how do i go about starting court action, dont have credit debit card to use online .. where do i go to start the action and what if any forms do i need ????:confused:
  • Hi, can someone help - I submitted a claim to Lloyds bank. Received a response stating that all cases had been put on hold.

    What do i do now? Do i wait for a further response from the bank or take the next step? If so, whats the next step?
