Advanced apologies for any ignorance from a newbie...
I am midway through martin's reclaiming process for 3k charges from 5-6 years ago and have threatened court action to no avail. Should I pay the £100 moneyclaim fee to stay in the fight, or take a breather until final judgement? Does the six year cutoff apply to when I first asked my bank for refunds or when the moneyclaim is issued?
Any advice or where to find these answers would be most highly appreciated.0 -

Well Ive never had any bank charges, or paid interest on a credit card. So I guess I must be terribly naive in the field of being charged for financial ineptitude. I'll yield to your great stupidity in this matter.0 -

After the OFT verdict does this mean in Scotland you can attempt to take a case to court? I started my claim for about £2500 way back in May 2007 with the Clydesdale who were slow and stubborn in sending any information then stalled as long as they could. I was happy to wait and know this is not a final verdict on anything really and have checked on sites like the Consumer Action Group and Govan Law Centre as well as going through this site and cannot really find an answer. Also does the 5 year limit include the delay time or are most people losing out as each day goes by? I have also emailed the Clydesdale on the 24th and and received this back
Dear Mr ******,
In response to your Message dated 24/04/2008 regarding charges, the
information we have is as follows - "On 24 April the High Court announced
its judgement on the first stage of the test case on bank charges. The
judgement is complex and we are currently considering its implications.
Further Court hearings will be required before the test case process is
concluded.
As previously agreed with the Financial Ombudsman Service and the FSA,
customer complaints relating to unauthorised overdraft charges will
currently remain on hold. We, along with the other Banks, will continue to
ask County and Sheriff Courts to keep cases relating to unauthorised
overdraft charges on hold until the test case process is concluded.
At this stage we have no further information, but if you would like to
speak to someone about your complaint, please contact the Advice Quality
Unit directly. Their office is open from Monday to Friday 9.00am to 5.00pm
on telephone number 0113 231 5035 or visit either of our websites

I was in exactly the same situation, a was a student for a couple of years and then on benefits as a single mum while i had £40 a time bank charge for being even 50p over my limit!! Now I have had a job for a month and I would love to chase the banks up...its still going to take a while to get on an even keel! If you hear anything about our rights now if the charges correspond to a time when we were hard up, please drop me a little message! Ta! x0 -
