  • (though I suspect the vast majority of reclaimers are not poor, but simply canny rational operators who know a good thing when they see it.

    Unlike yourself, I don't base my views on assumptions. I prefer to base mine on facts and there is plenty of evidence out there that proves, as a category, the poor, vulnerable and low paid pay the loin's share of day to day banking in the UK.

    As it happens. I fall well outside that category and and from my uncontaminated perspective, things are very clear.

    You won't believe this and I'm really not trying to be flip but could you not just have eaten beans on toast for a month or two?.
    I promise you, I did, and 10p instant mash, which I actually still buy today cos it is every bit as nice as the branded stuff. :p
    I also sold my car & walked a 6 mile round trip to work every day. Spare me the violins, I needed that cos I was getting too fat anyway!

    The thing is, eventually a mate lent me the money to clear it all. I repaid him and was back on my feet in no time because when I gave him £250, he wasn't fining me £200 of it every month. It really was expensive being broke. Fortunately I do just fine these days, but I found out the hard way how quickly & how savagely you can spiral into debt by just one slip.
    Like I said before, I am happy to pay for my mistakes. I wouldn't encourage or applaud anyone for spending like mad & to hell with the consequences. All I wanted was some help when I needed it and not be continually fleeced. Luckily I had someone who could help. Many others don't..

    It has not been decided the the charges are unfair, only that the OFT have the power to decide if they are.

    Start your court claim now. Even if it is stayed, it means you don't loose out on the six year limitation rule and also should speed up the process of any refund.

    According to the banks, the courts are the only ones who have the power to decide if the charges are fair..see abbey statement.
    Can anyone actually tell me if there were any winners from the court case, both the banks and OFT are pleased with the outcome?
    Do you think it would have been a different outcome if the OFT used the t&c of old.
  • Sorry, you overplayed your hand. Yes you do base your views on assumptions, and I'm afraid they're wrong.

    There isn't. In fact, the richer you are, the more you are likely to contribute to a bank's profits. That is why rich people who open bank accounts get offered free plane tickets, whereas poor people have "access" accounts which banks won't even tell them about if they can get away with it, in many cases. Rich people actually borrow more, all things being equal. They can get bigger mortgages, even as a multiple of earnings. And more debt, until the past year anyway, has meant bigger profits, to say nothing of fees on investment products. Oh and by the way the truly poor are not offered credit facilities if they are able to find a way for a bank to open an access account for them in the first place. (That's not, by the way, to suggest that people don't fall between the cracks, have runs of bad luck, or that circumstances don't change.)

    Anyway, I'm glad to see that you are championing the cause of the poor, with no self-interested motive in mind as you're "uncontaminated" (your word) by poverty. LOL - that's right, you're not, you're on the take too. Would asking you to be honest enough to admit you let things slide and you've seen an opportunity to get some cash back, and that you're taking advantage of it be too much to ask? I think that's a perfectly respectable position and the one I would take if it had happened to me. It's the moral outrage which doesn't sit very well.

    I'm afraid that every single assumption you've made of me is entirely and utterly wrong. My 'uncontaminated view' means that I don't have anything to personally gain from the bank charge campaign and it was not a derisery comment aimed at the poor as you implied.

    And I reject your view that I'm ''on the take''. I don't claim bank charges as I don't incurr them. If I was on the take I wouldn't have donated £60k in the last 12 months to the campaign against them.

  • Hi. Iv just got my summery of my account but it dose not have the day of the charge just the month and year. Do i have to ask for a new summery with more detail? Also it only goes to Dec 06, and not to date do i have to ask for this too?????
    I need help pls reply..

    Look at a current statement and see what date in the month the charges go through and you'll find that its usually the same day of the month.
  • I am helping a friend who has a HSBC business bank account which unlike most personal current accounts, there are charges for everything from depositing cash to paying by cheque etc. He has exceeded his business overdraft on many occasions and therefore incurred huge charges. Is he still able to claim back these charges even though it is a small business account? Also why should business accounts be charged for simple things like paying in money to their own account?
  • Have taken the bank to court last year April 07 just when the hold was put in place does this alter anything or does the Bank have to start where it left off it cost £120 to file a claim do i have to wait till 22 may or do i contact the court or the bank again asking them to settle claim NOW thanks
  • Well done for standing up for what you believe in. Taking you at face value, of all the things to throw money at this seems an extraordinary choice even if dealing with UK poverty is your number one concern, but it is yours to do with as you will, though I wonder if you have given much thought as to who the banks' shareholders are.
