The official definition of being drunk and incapable is when you are so drunk you are unable to stand or walk or unaware of what you are doing or unable to understand what is said to you. You apparently were unaware what you were doing with the chip and pin machine.0

Do you mean capacity, as in lacking the mental capacity to contract, not "condition"? Please don't just say random words when claiming to make a legal argument.
I would say that if you managed to remember and enter your PIN, you were surely capable of reading the numbers on the screen just above the numbers on the buttons.
yes, I meant capacity, and it is clear you know what I meant. I don't buy this thing about remembering your pin meaning you can't be that drunk - certain things come naturally to you e.g. your name, how to walk, breathe etc (im sure someone with a knowledge of how the brain works could give a medical explanation)0 -

It's very, very hard to have any sympathy at all for people that drink themselves into incapacity and then blame someone else for the consequences. Did anyone force you to get blind drunk and then go to a strip club?
To be honest you're the bad guy in this story - you're the one supporting an industry that at best merely exploits vulnerable women and at worst actually trafficks and enslaves people. It seems this club is notorious for being a brothel so please explain again how you're the victim?0 -
I think some of these responses are unduly harsh! If you happened to go in to Tesco drunk and they charged you £2k for a pint of milk because you're not on your game and they think they could get away with it there would be outrage. Why so different because the services are a little more 'exotic'?0

The "harsh" responses are because it's well known that frequenting such establishments is, at best, very expensive and, at worst, even more expensive.0 -
getting exploited? apparently they're self employed and can charge £10 for a dance or £3000! I'd say they're doing quite well out of it. I didn't realise it was notorious for being a brothel - ive never been there before or even heard of it until this little situation. I'm not going to feel bad for going to a strip club, nor am I going to accept that doing so and being drunk disqualifies me from having any rights0

Not quite the same thing, but if a girl was incredibly drunk and didnt know what she was doing, and a bloke took advantage, she could claim rape and the bloke would be judged at fault, a la ched evans or whatever the chumps name is.
Still think you're an idiot taking your credit card though.0
