Anyone else been advised by Thomas Cook to resubmit their claim as I have?? I had previously sent a NBA on my case, So do I keep with that and just let my resubmitted claim roll on ???
But would like to know if anyone else has resubmitted their case on TC suggestion ??0 -
Resubmit your NBA but with the updated referrence to Court of Appeal rulings on Huzar and Dawson and Supreme Court denying leave to appeal on these cases. If you're new. read The FAQ and Vauban's Guide

Sorry, resubmit my NBA on to the new submission or the original?? Am getting confused here.
Write to the airline one last time, referencing the Supreme Court's decision, and giving them 14 days to settle your claim. If they'll settle, they'll settle: and if not, you know it will take court. Either way, at least you force their hand and bring this to a conclusion.0 -
Having trawled this site for 3 solid hours now and at the risk of appearing to be a total prat....What is a "sticky"? And could someone please post a direct link to Vaubans guide? Many thanks0

Have had claim going against Thomas Cook since July 2013, went to NWNF company end of last year, who have taken the case to court. Received a copy of a letter from TC's solicitors dated 13 November 2014 to the County Court.
Basically states Thomas Cook's solicitors are awaiting instructions from their clients and anticipate those by the end of this week (last week now) Until they are received they are not in a position to suggest further directions for the progress of this claim and will be in contact with the court as soon as possible.
....... so watch this space:)0 -
As expected, stonewalled by Ryanair once again (response to the NBA template letter):"I acknowledge receipt of your letter dated 12th November 2014.
Whilst we sympathise with your view, we regret that our position as set out in the letter dated 11/11/2014 remains unaltered.
We are sorry that we cannot be of further assistance with regards to this matter.
Yours sincerely,
Ryanair Customer Service Department"0 -

Yes. Don't forget that, because it is Ryaniar, you need to sue them in Ireland using the European Small Claims Procedure - it's a paper process, so you don't even need to go to court. Dr. Watson's posts have all the necessary information.0
