I have paid the fine anyway now, and I have sent the forms off with the following witness statement.
• Default Judgement
• I understand that the Claimant obtained a Default Judgement against me as the Defendant sometime in 2014. However, I was working in Germany for the xxxx from February 2014 and therefore did not receive this. I was unaware of the Default Judgement until I returned to the UK at the end of my contract.. In support of this I am attaching my Contract and extensions, which will prove my location and the duration that I was out of the country. I can if needed provide a reference of my work at the xxx as proof.
• I have did have my mail checked periodically, however never received any documentation from the Claimant in this and this was only brought to my attention upon being turned down for a new employment contract due to a failed credit check.
• I have never had any credit issues at all in the past. I now find myself with this judgment, without any prior knowledge, which would have enabled me to resolve this matter.
• I am a self-employed IT worker, and this judgment against my name has made my chances of finding new work more difficult. A large proportion of IT contracts are situated within finance, and this has already damaged at least 1 possible role (that I know of) due to a failed credit check. I work hard and pay my taxes, have never broken the law. I certainly would have resolved this if I had been informed.
• On top of this, my family had made plans to move home in 2015 for the benefit of our children. This has now been made near impossible due to this judgment and now forces me into a position of failure as a father.
• I also appealed to the claimant about this, and I am awaiting their reply. The fine has since been paid, therefore I am hoping after reviewing all evidence, they will provide any required assistance.
• Considering the above, I was unable to resolve this claim. I thus believe that the Default Judgement against me was issued unfairly and thus should be set aside.
I have also included my contract that proves my employment and where I was. Ive sent the same to parking eye.Waddle you do eh?0 -
You've paid Parking Eye? Why have you done that when you've applied to have the judgement set aside?0

That will remain on your credit record as a satisfied CCJ. A set aside would have seen it removed.Je Suis Cecil.0

How much have you paid them? They'll be wanting the full amount of the judgement as this is the original charge plus the costs they've run up trying to get the original charge.
£60 won't change anything, but you have now admitted liability, so your chances of getting the judgement set aside are in tatters. To get a judgement set aside you need to;
1. Demonstrate why the original claim was not responded to (you didn't receive the paperwork is usually fine)
2. Demonstrate that you would have a reasonable prospect of defending the claim.
By paying the original charge you've destroyed #2.

See if you can halt the set aside and get your money back for that.
MKe sure the ccj is marked as satisfied.
Learn to live with a satisfied ccj.
