The operators need to start dropping CPW like they have P4U and then customers can just go directly to the network operator.0

and on a side note Vodafone rep, I also made a formal complaint about one of your advisors around 8 or 9 weeks ago, in which she refused to give me a pak code as i owed you money, another breach of ofcoms rules, this was also in a recorded phone call, another one of your colleagues had to apologise for her actions and then issued me my pak code instantly.
so there we have Vodafone refusing to give a pak code because of a outstanding debt, when as we all know I could of owed you a million pound yet you would still have to give the pak code when requested.

update:
Vodafone via lee, fully now admit they were made aware in 24 hours of me taking the phone back that I had cancelled the contract - due to maladministration this was not picked up on earlier.
so 3 months of hell could of been avoided had they looked into this matter when I first complained about it months ago.
we are now in discussion over next 7 days as to a suitable compensation payment and a full written apology.
the evidence does point to harassment, libel and defamation, as well as having debt collectors let loose on me, and basically lies reported to the cras.
it has took lee less then a week to get to the bottom of this, however this is not the point it should of been picked up on earlier, this also goes to show that after countless phone calls I was not took seriously and my complaint and concerns were ignored, why oh why did it take a complaint in a public forum to get this matter picked up on and a proper investigation launched?0 -
I have to say, I suspect that Leroy may well be completely in the right, despite his spelling.
It sounds like it has finally been sorted out by Lee's intervention, but there is no way it should have got this far. If OP followed the terms of the contract and the dsr, the contract ended.
Adverse marking of someone's credit rating can be libel even if someone on the organisation believes it to be true. Believing something to be true is no excuse for libel.
If you hear a rumour that you believe to be true about someone and you write it to someone else as fact, this is libel (unless it really is true).
It is also not uncommon in civil cases to take more than one party to court if the blame is uncertain and let the court decide whose fault it was.
If VF and CPW have an arrangement to sell phone contracts, they have to have an arrangement to deal with phone contract cancellations, and also have to have sensible procedures in place at both ends to deal with this arrangement breaking down. It should not be up to the customer to act as go between.
And the suggestion that CPW should give the OP a cheque to bank and then pay VF is bizarre. It would have meant that the OP would have accepted the debt and then the adverse credit rating would have stuck.
Glad it was sorted out in the end, but no one should have to put up with debt collectors and adverse credit ratings in this situation. I hope he does get some sort of compensation.0 -
I was right along, I took the phone and cancelled the contract to carphone warehouse within 14 days, car phone warehouse notified Vodafone of this 24 hours later, the matter is not closed until I am compensated, my credit file restored and a full meaningful, written apology arrives through my letter box.
I can now prove beyond a doubt that Vodafone's actions were harassment, I told them of this countless times but they chose to ignore me, despite it been on Vodafone's system that car phone warehouse had notified them I had indeed cancelled the contract 24 hours after I returned the phone.0 -
Firstly dont get too worried about compensation, the number one priority has to be to fix any damage to your credit references. Compensation for the hassle/phone calls/costs etc whilst reasonable should not be done without making sure the credit reference stuff is dealt with correctly.
Ask for everything in writing.0 -
yes the credit file needs to be marked correctly, no red marks, nor late payment markers, I need to check on how it should be marked correctly...0

lee just rang:
1. debt collectors now called off
2. credit file restored.
I have asked this to be all put in a letter and sent to me, there has been no apology for the harassment and libel etc.
they are refusing my claim of £250 compensation.
do I
a. refer this to ombudsman
b. request in writing the amount im claiming once again, directly to the ceos office giving them one final opportunity to pay what im claiming.
c. without further hesitation submit a claim to my county court?
whats your opinion's?, personally I favour option c, in which id seek costs of bringing the claim and 8% interest etc.
they seem to think they can just get away with what they have done over the past 3 months, I will however not let this matter lie, and the fact I can submit a court claim online makes this a easy process.
baring in mind what they have done, and the refusal to investigate my concerns and ignore me until I posted here.0
