Whilst it was not the correct way to do it, as it was a shop and not online, do you have any documentation from CPW that it was cancelled with them?
it was bought online, I selected to pick the item up at a local store, as couriers and post man have a habit of leaving items with neighbours and not putting a card through my door.
the only evidence I have that it is cancelled is that they (carphone warehouse) tell me every time I ring them that the contract was cancelled, im going to get this in a email from them too, nothing was given to me by the store when I took the phone back to them, its one big miss, but it is Vodafone that are acting illegally, not to mention breaching guidelines when they knew full well this debt was in dispute but they still called in the debt collectors.0 -

The debt collectors should be informed when the dispute is raised.
As it stands at the moment the dispute is with CPW as they are the vendors and Vodafone will require proof the contract was cancelled.It's not just about the money0 -
the dispute was raised within a few days of taking the phone back to the carphone warehouse, as by then I had got my first "normal phone bill" from Vodafone, I rang up to tell them the phone had been took back / cancelled, they said don't worry about the bill and it would soon be cancelled of the system (as returned) and all id have to pay was any call charges I made out side the inclusive minutes.
then weeks later another bill came, it was at this point I rang them again and told them the contract had been cancelled a while ago, that I did not owe this money and the amount was now in dispute, they called in the debt collectors maybe a month after this.
exactly carphone warehouse appear to not of told Vodafone it was returned, however the point is any obligation I had to Vodafone was stopped when I cancelled the contract in the car phone warehouse store, it is them that should be sorting this out between them, not dragging me into it as I am the innocent party in all this due to the fact I returned the phone and cancelled the contract, hence the only way to get these fools to talk to each other, and to get this mess fixed is to get the pair of them into mylocal county court..
the judge will first want to know if I cancelled the contract within 14 days of receiving it - carphone warehouse "yes my honour he did in deed do that"
this dispute is between carphone warehouse and Vodafone, it no longer has anything to do with me, however Vodafone are doing what I have stated above in first post, its them im going after.0 -
As a worker for Cpw we are seeing this a lot, we return the phone / contract our system backs this up, we then get a angry customer 3 months later saying the network haven't cancelled the contract, communication somewhere in the chain is lacking as personally I'm sick of dealing with this very issue.
What ends up happening is the store (that you have given no business to) has to take the hit for the total amount of the contract. And the manager spends hours of his time fixing the issue that is really nothing to do with him, have you tried ringing head office for Cpw ?
It won't reach court, and I highly doubt your attitude is doing you any favours. Get a return receipt from Cpw and give it to vodafone? Or go instorecand have manager rinf Vodafone0 -
lol my attitude? 3 months of hell debt collectors, harassment, alleged debts, I have every right to have the attitude I have, and it will reach court because that's where its heading, but yes I expect everyone will settle out of court.
what losses cpw suffer is of no concern to me, this whole case rests on one simple legal point, and that is did I cancel the contract within 14 days of receiving the phone, the answer to this is yes, its as simple as that.0 -

I'm not saying it's a concern of yours, I'm advising of General policy for what happens in these situations. I don't understand how it's got to the 3 month mark its normally solved within 2 weeks.0 -
