You returned the phone, You have a verbal confirmation of this.

CPW confirmed verbally the contract was cancelled. They have put nothing in writing.

Vodafone are doing what they do if you are a customer, directly or indirectly.

The problem seems to lie with CPW given they keep writing off the debt and taking the full hit. Its not Vodafone you should be berating, its clearly CPW who are not doing the job rightly by informing the network of the circumstance.

Whilst I have my issues with Vodafone, I have to say its CPW you should be dealing with and having them take responsibility for the situation they caused.

but carphone warehouse cant call of the debt collectors and cant put right my credit report mate - this is the problem, how the hell can I sort these 2 large companies out? my only avenue is court to get them to talk to each other, im not a customer of either of these companies, the contract has been cancelled, my original purchase was with the retailer car phone warehouse, so took the phone to them to cancel the contract, they have done there part.

exactly carphone warehouse appear to not of told Vodafone it was returned, however the point is any obligation I had to Vodafone was stopped when I cancelled the contract in the car phone warehouse store, it is them that should be sorting this out between them, not dragging me into it as I am the innocent party in all this due to the fact I returned the phone and cancelled the contract, hence the only way to get these fools to talk to each other, and to get this mess fixed is to get the pair of them into mylocal county court..

the judge will first want to know if I cancelled the contract within 14 days of receiving it - carphone warehouse "yes my honour he did in deed do that"
Which is why you need to press CPW to sort it out.
CPW are the third party sellers and who Vodafone take instruction from.
The Judges second question would be do you have any proof or documentation the contract was cancelled or a receipt of the return?
Sadly you haven't which is why you need to obtain one.

The next problem you will need to deal with is that it's more than likely that as Debt Collectors have been involved, your credit rating will have taken a hit and need to be removed once you get it sorted out
It's not just about the money
  • and it don't help when this is on car phone warehouse website:

Clearly CPW haven't done their part otherwise you wouldn't be in this situation.

CPW can. Its their responsiblity to resolve your situation. You were
CPW's customer. You cancelled the contract you had with CPW, which in turn cancelled the contract they had taken out on your behalf with Vodafone.

This means the problem is CPW's to solve. No matter what your gut instinct will be. You need to get irate with CPW not Vodafone - ironically your approach with Vodafone could be a problem for you rather than a help.

The good news is if Lee @ vodafone does pick it up, he tends to work far beyond his remit - he is fully entitled though to refer you back to CPW - its their lax closure on your contract situation which has put you in this position.
  • once again they have apologised and escalated this to someone higher, one of the possibility's is carphone warehouse send me a cheque for £600 to then pay Vodafone, ive never heard of anything like this in my life, it truly is crazy.

how can this company just take a £600 hit as if its totally normal, this needs ombudsman / regulator intervention.

im also seeking damages from Vodafone / carphone warehouse - utter madness.
