vodafone, harasment, libel, defamation breach of dsrs etc etc etc

  • cheers visidigi it wont let me thank you for some reason, I do hope that the majority of you can see that this is unacceptable and has been caused through no fault of my own, but yet it is me that is suffering.


    im now waiting from letters from my my bank accounts / credit cards etc saying limits are been reduced etc etc

    I suspect they HAVE to take the hit.

    Because they haven't cancelled the contract that they sold to you and have to pay the ETF to cancel it now at the total cost of the minimum term.

    If they do send you a cheque then this means that they acknowledge their mistake and it proves that Vodafone have acted in line with the contract. They will then need to ask Vodafone to correct any potential error nous entries on your credit file.

    For me the subject line is unjust and the claiming of compo from Vodafone equally so. This is CPW's fault through and through, Vodafone are just doing what the contract said that you agreed to that CPW failed to cancel.

    it is Vodafone that have harassed me, under the wrong belief that the contract was not cancelled, there Is no way im just going to put these 3 months to bed without been compensated, as it is me that has had to sort this sorry mess out - when I was under no obligation to do so, all my obligations ended when I cancelled the contract.


    I also don't see why I am under any obligation to then have to go into town, bank a cheque wait for it to clear and then to pay Vodafone with carphone warehouses money - this is not down to me, carphone warehouse appear to owe Vodafone the money, I am not some middle man payment service - it just goes on and on and on, and looks like I have to do more leg work - these 2 companies need to talk to each other and keep me out of it! it has nothing to do with me.


    I want compensated, debt collectors called off, and my credit rating fixed.

    and thast the point, the contract carphone did not cancel with Vodafone, the contract between me and the carphone warehouse was cancelled in line with the dsrs, there is not and has not been any contract between me and Vodafone as it was cancelled.

    and if they don't play ball, then the pair of them are named as co defendants and I submit the claim to my local county court, it really is that simple.

    You're not listening.

    You took out a contract via CPW with Vodafone. The return was offered and handled by CPW. CPW were obligated to tell Vodafone that you had returned and cancelled the contract.

    CPW didn't do this.

    Therefore Vodafone acted in good faith that you had failed to pay your bills and that they were owed the money. They passed it on for chasing inline with procedures they have.

    Vodafone need to be told by CPW. If CPW had done their job properly you wouldn't have been chased by Vodafone. You're trying to put the cart before the horse by saying this is Vodafone's fault. CPW caused it. CPW have to fix it. You want compo that will have to come from CPW, not Vodafone.

    You can't blame Vodafone for chasing, you shouldn't have been telling them they should stop chasing you, you shouldn't have been sending them fundamentally threatening emails. You should have told CPW to sort it.

    If you took this to court for examples sake - you were CPW's customer, not Vodafone's - you would only be able to go after CPW - after all, you didn't return the handset to Vodafone now did you...

    Your anger is in the wrong place going after Vodafone, despite your mood and feeling telling you otherwise.

    This is incorrect, CPW introduce you as a customer, when you were on the network and took delivery of the phone you had a contract with Vodafone, with CPW as the introducer.

    As the contract was cancelled under DSR's the intrducer needs to handle the return and the cancellation.

    They handled the return, they didn't handle the cancellation with the supplier. A contract in your name which you gave them approval to obtain on your behalf when using the CPW service.

    Vodafone still have a contract in place because CPW didn't cancel it. Vodafone are chasing you for the payment because of this. CPW need to fix your situation, Not Vodafone.

    im fully listing to you, the point is yes car phone warehouse have caused this, but the point also is fact that I cancelled the contract with the carphone warhouse.


    what happened then is outside my control and has nothing to do with me, this is a error with car phone not speaking to Vodafone, there problem not mine.


    I see your point Vodafone believe I owe them the money because of car phones maladministration, but that is a internal issue between the two of them, the fact remains I am not guilty of any wrong doing ad do not owe anyone a penny, it is a fact that Vodafone are sending incorrect info to the credit agencys - no matter if they belive I owe them money or not, because it can be proved I cancelled the contract at carphone, Vodafone have been made aware by myself for coming up to 3 months that I did not owe them this money and the contract had indeed been cancelled,


    it was them who chose to ignore what I was telling them, continued to harass me for money, libel and defame me, under the wrong belief that I owe them money, yes the carphone warehouse may of caused this, but Vodafone's actions are still out of order.


    I will keep this updated, as I see no end in sight soon, I have decided though that im not banking any cheques and then passing money on to Vodafone.


    there is no debt between me and Vodafone I do not owe them a penny and they are feeding incorrect info to the cras, under some fantasy that I owe them money.

    As it stands at the moment there is a debt between you because it's not been proven otherwise as far as Vodafone are concerned.


    If you provide them with some sort of proof of cancelation they will close the account and chase CPW.
    Even if CPW send a cheque the debt will still show as outstanding and then even if you pay Vodafone it would only show the debt as settled on your credit rating.


    You don't need it escalating you need proof of cancelation and return from CPW, once you have it you can put it to bed


    You chose to go through a third party as explained earlier and because of that you are stuck with Vodafone taking instruction from CPW
    It's not just about the money
