    Hey RC!

Knew it was coming sooner or later. Just got this text:

My contract is due to expire this September 2015. It was taken out September 2013.

Where do I stand? What are my options for fighting against the increase?

My case is finally with the independent reviewer after CISAS kicked my second case allegedly because my case was a "Disputes that are the subject of an existing or previous court action or existing or previous valid application made under the Scheme;"

I suspect any application to CISAS would be rejected by them.

It would however be interesting to see whether CISAS would this time allow you to comment on their rejection.
  • Got my text today as well

Gave up a while back after not knowing who i was actually complaining/appealing to as they were all so useless! Probably what they wanted so well done Mikmonken for continuing forward. Im guessing as ive been rejected last year there isnt any point me starting again?

Cant wait to get rid of these crooks

I'm pretty sure I had chance to rebuttal, but I had done it once already and it was getting nowhere so I cut my losses at the time.

My contract runs out in September, so at this point I'll probably wait it out. I'm indifferent about EE, my phone has worked and had decent 4G so its done its job. I just have issue with being charged extra every single month for making 08 calls or etc, there's so many rules you have to know them all! Or remember to always use the WeQ4u app.

Currently I'm pretty sure I'll be leaving when my contract comes up, jumping on the BT sim only deal think its £25 a month for 20gb data(HUGE, mines only 1.5!), unlim mins & texts, and BT use and are buying out EE newtorks anyway so win-win.

Really did not think EE would go to the trouble for 0.9%!

Their contract I snow much more defendable than the old clause - which was unenforceable.

Argument to get out of the contract:
The increases is of Material Detriment to you both under the contract and Ofcom regulations as they have used RPI and not CPI - therefore it is a real terms increase
Arguments to use to stop the price increase being applied:
    Under the UTCRS:
    1. EE can not pass on risks that they should have taken account of (inflation)
    2. It is unfair because you can't tell if their costs have actually increased by this much. but you know they have not because they have applied inflation to the full cost which includes the phone which they had already purchased
    3. They need to prove that they have not already factored any inflation into the original price (they are on record as telling Ofcom they can predict certain costs)
For my part I no longer take out phone contracts - it is cheaper to buy a phone on a credit card and use sim only in my opinion.

I am still trying to tae Ofcom to the Parliamentary Ombudsman, but now have to wait until after the election as my MP needs to sign it!

I too lost nearly £200 cash-back because of P4U, please keep us informed on how you get on.

So I haven't yet received any reply from EE and sent them another email on Friday. Maybe I will have to actually write to them?! Did not realise they would be so useless!

The above story suggests it might be worth writing direct to the new Businees Secretary direct about EE.

    EE fined £1m by Ofcom

Remember last years issue where EE were failing to issue deadlock letters to take the case to CISAS (change in the terms and conditions) and failing to inform the customers of their right to take the case to an independent adjudicator? This is the reason for the penalty. Not much for a company like EE but still.....

Thanks RandomCurve once again for all your efforts!

I was just about to buy an Iphone 64gb with £152 upfront and £32 odd a month, but after seeing this thread I am NOT.

My last provider may not be brilliant but they do not behave in this shoddy and unfair way.

The fact that you have to have a campaign is bad enough but their continued slippery activity as reported here makes me say "no thanks".

It is a shame that neither of the E's stands for Ethical, I will vote with my feet and count myself lucky.
Please be nice to all MoneySavers. That’s the forum motto. Remember, the prime aim is to help provide info and resources. If you don’t like someone, their situation, their question or feel they’re intruding on ‘your board’ then please bite the bullet and think of the bigger issue.:)
  • I also never had been informed about the new increase.
  • I've just been trying to cancel my account and didn't realise I had to use the PAC code before the end of the 30 days and hence has rolled over. EE say I have to pay the full month even though I change to another provider. I'm very angry!
Is there anything I can do? Is the Reclaim process still valid, should I do this?
    Many thanks

    Gary
