Hi all :) I've not been here for a while, but I really need some help. I've tried contacting a lawyer but there isn't an appointment available for weeks and they want to charge me £80 for the privilege. .. I just need an answer to one question. Can I have my child's biological father removed from the birth certificate in exceptional circumstances? I live in Scotland... Thanks :)

A simple google provides the answer to your question

    http://www.adviceguide.org.uk/scotland/relationships_s/relationships_birth_certificates_and_changing_your_name_s/birth_certificates_scotland.htm#h_making_changes_to_a_birth_certificate

"The father's name cannot be removed from a child's birth entry if he is the biological father of the child. A father's name can only be removed from a child's birth entry if it has been established in court that he is not the biological father of the child."

I saw that and sought advice from citizens advice and they said that they only have limited resources available and they could only advise what you have posted above... but due to the circumstances they feel that it could maybe be possible and told me to seek legal advice... I just wondered if anyone had been able to remove the fathers name even if they are the biological father?

    What are the circumstances?

I don't have any legal knowledge but I don't see how it would be possible as it's a legally factual document.

Hopefully someone else more knowledgeable will be able to help.

No you can't remove his name , except in the circumstances described in #2.

A birth certificate is copy of the original birth entry which records the facts of the birth - unless that is factually incorrect it will remain as a true record.

He hasn't seen his father for 8 years... and after what has happened in the past year no child would want any connection with vile scum like that :( I'm doing everything to protect my child and if/when he asks about his father, myself and my partner will sit and discuss it with him... as hard as that will be :( I don'twant any record of his name being connected to my son... I'm honestly in shock and utterly sickened by the whole thing :'(
Thank you for your concern though... I completely understand where your coming from x

If the child were to be adopted by a step parent, a new birth certificate would be issued, according to this:

I don't know if it is similar in Scotland.

A certificate from the Adoption register (which is the equivalent of a birth certificate) will be issued showing the adoptive parents details , but that will not change the original birth entry.
