    So please can you confirm which is the correct route for a claimant with a spouse and children? Thanks :)

    If a claimant isn't listed in the claimant box using MCOL, then they aren't strictly claimants, so use N1 if you can't list them all in the claimant box on MCOL.

    To be a claimant formally, you need to be named in the Claimant box. MCOL doesn't seem to permit multiple claimants, which is why the N1 paper form is necessary (and a separate form for children). If you don't do this, the airline is likely to object. Of course a judge may cut you some slack - the evidence from reports on here is mixed.

    But that isn't always a cure to a bit of a self inflicted administrative headache and the airline's solicitor knows this, they have other options up their sleeves.

    I know this because it happened to me.

    My advice is to advise not to use MCOL at all, it'll save future claimants from what can be a very very bad administrative headache.

  • Thanks for the guidance. I have downloaded the N1. So the 2 parents go on there. What form for the children? How many fees do you have to pay, is it just one lot for the whole of the claimants?

    Been looking on web for a couple of hours can't find anything much about the N1 route, even on Martin Lewis flight claim info he just has links to the MCOL.
    I will advise my friends down the N1 route, but the N235 looks a bit complicated :/

    I thought your time was limited - I seem to recall October 12th (???) - think you are 'pushing it' now to get everything completed and to Salford in time.
