Vauban, well done, you've put together some very useful information in your guide.

I am in the process of using resolver to claim delay compensation from Thomson, but I get the feeling Thomson at all levels (the claim procedures are almost all exhausted), either don't bother reading claims, or just ignore them once read.

The next 'escalation' will be in a few days time, and it will involve writing via Resolver to the Passenger Advice and Complaints Team, which appears to be an arm of the CAA. And from what I'm reading in this and other threads the CAA are virtually a waste of time. They have no teeth, and can't force an airline to pay compensation. Add that to the fact they are way behind with complaints, according to their own website, and it seems a waste of time even contacting them.

I'm considering either taking the airline through the Small Claims system, which would be worthwhile as the amount I'm asking to be compensated is 600 euros, or using a claims firm.

If I thought I'd stand as much chance of winning by doing it myself I'd go that route, rather than pay out the charges a claims company would ask. Something I need to think about though, as obviously I'd prefer to pay a firm who are professionals and win, rather than go it alone and then perhaps lose.

skip the CAA, total waste of time

Successfully sued Ryanair in 2013/14...and have been 'helping' litigants since then.

    Current known score:-
Dr Watson 35 - 0 Ryanair / Ince and Co

Go to post 622 on the Ryanair thread to read how to sue them safely.
  • Time for another go on the Dodgems
The above is just my opinon - which counts for nowt! You must make up your own mind.

my daughter and I were delayed at Manchester for 8hrs in august 2005 flying to turkey. Our Turkish friends were picking us up from the airport so we payed extra for the earlier flight so as not to ,
inconvenience them but ended up on the evening flight anyway. Also , my other daughter, her family and parents inlaw were delayed on a flight from turkey to Manchester due to overbooking so had to stay in a hotel overnight and fly home the next day.We have tried for compensation but they want all the paperwork (booking and boarding passes etc) Who saves all that for 5 to 10yrs?.So we would appreciate any advice on this problem.Surely the airline have confirmation on them. Both flights were with Thomas cook .

Ginnie - I guess you missed this post https://forums.moneysavingexpert.com/discussion/5173888
but basically you are over 3 years too late to claim - the airline can happily reject your claim or ignore you as the time limit for going to court is 6 years
You can make a SAR if you wish but I would expect the chances of receiving any compensation would still be 0%
  • Sorry Caz I failed to give the date of my other daughter's flight.
She travelled with her family from turkey to Manchester with Thomas Cook in May 2010 and was unable to fly back due to the airline being overbooked so had to spend a night in a hotel and fly out the next day. However she has obviously not saved any paperwork and the only proof she has would be their passports. She has contacted Thomas cook and they told her without boarding passes etc she has no chance,Who saves all that for almost five years?
  • Hello - apologies but I haven't read the whole thread due to time, and I have printed the guide for reading later.

However I wondered if it was a common turn of events for an airline to simply stop responding to your emails, despite agreeing they were liable in the first instance?

I have made a claim against AirBerlin for abandoning us in Frankfurt with no accommodation or sustenance (ie zero duty of care) after delays to a flight in Sicily meant we could not meet our connecting flight to London - we ended up spending out our own money for accommodation and transfers, which given the scarceness due to the International Book Fair meant we were quite substantially out of pocket and far from local.

So compensation aside, I have been trying to get the extra expenditure back, but am receiving radio silence from their customer services on every occasion. They will not even supply me with a reason for the delay so that I can initiate my claim with my travel insurer.

There is a lot more to it than I shall bore you with here, however any advice on being treated so miserably would be greatly appreciated!

    Many thanks
