Sorry, I don't "do" iPads!I-LOV-MONEY wrote: »Do I have to do this? I have been in e-mail correspondence (see posts above) with the Management company saying that I do not wish to participate in the scheme (is that enough?). Should I also write to Park Direct UK ? Is it actual trespass to put a ticket on my windscreen?
No of course you don't have to do it, you don't have to do anything if you don't want to. It is not related to any potential PoPLA appeal, it is simply another string to your bow. Attaching a ticket to your windscreen could be seen as "trespass to goods", and would certainly be trespass to goods if they caused any damage while so doing. Anyway, telling the management company that you will consider it as such will give them further food for thought and add to the notion that you and your car are simply too hot to handle.I-LOV-MONEY wrote: »Oh dear. It will have to wait till I have some time available.
The time when you might need to do a PoPLA appeal is weeks, probably months, away.I-LOV-MONEY wrote: »Can the Management Company bring in a new rule which isn't mentioned on my lease or do they have to submit a new lease?
Depends what the lease says, but it doesn't really matter, it's not the main point on which you will win a PoPLA appeal.Je suis Charlie.0 -

Sorry to be pedantic, but should I also write to the Parking Company saying similar and adding that it is not in my lease.Thank you for reading this message.0 -

If you are minded to do it then you write to the parking company warning them that interference with your vehicle (e.g. by attaching anything to it) will be treated as trespass to goods, and you write to the management company saying the same thing and adding that you will hold them liable for any such trespass by their agent (the parking company).
I think you said earlier that your lease makes no mention of parking, so probably best not bring it up.Je suis Charlie.0 -

Further information. Last night when I went out, I noticed that the signs only go up to number 50 - the street has 60 houses (so are the last ones exempt?!). On entry to the street (there is only one vehicle access to the road) there are no signs, and they do not start until about a quarter of the way down.
The beginning of the street is actually owned by a different property management company (historic reasons!) . I was told that they were in agreement with the proposals for a PPC, but there are no signs on their land.
So basically it is the middle section that has been 'affected' . Does this make any difference to anything ? Also the neighbouring roads that should have been included there are no signs whatsoever.
P*ss up in a brewery come to mind.
One of my neighbours said that had I not mentioned the signs, when she came home last night she wouldn't have noticed them as they are so high on the lamposts.Thank you for reading this message.0 -

Not that I want to go to the expense of a 'signed-for' letter, but why shouldn't I use it? I obviously have to give them my address so they know where the car is parked.Thank you for reading this message.0 -

Because PPC's may refuse to sign for it. If you send something by ordinary mail, and get a free proof of posting, the law deems it received after two working days, you don't need a signature as proof.Je suis Charlie.0 -
I have now written to Park Direct (copied to the Management company) as C-M suggested above, and obtained proof of posting.
I was alerted on another thread to the BPA Code of Practice on entry signs. There doesn't seem to be any specific entry signs.
Incidentally the street signs have been put on lamposts, above eye level. I am looking at one opposite me and it is eye level, but I am on the first floor! I suppose you maybe aware on driving in that there is a sign, but you wouldn't be able to read it before stopping and parking.Thank you for reading this message.0 -

Do they meet the size, colour and other criteria in the Signs appendix in the BPA CoP????0 -
