MSE News: 'Don't pay unfair private parking tickets'

  • Hi. I received a parking 'Invoice' from Parking Eye after parking at a HolidayInn. I didn't see any parking notices, but still asked reception if I needed to pay to park and if so, how? The receptionist asked how long I would be staying to which I replied 'three quarters of an hour'. She said in that case there would be no charge. I left after 39 minutes. I have ignored their correspondence (rightly or wrongly) although did complete a questionnaire for small claims court and also accepted an invitation to mediation, but have now been asked to attend court on the 3rd December. I never received any mediation. Parking Eye also state in the letter that they will not be present but request that the matter be decided in the presence of their advocate, which I find infuriating since they want me to attend! What should I do? Can I win if I do attend court or should I try to 'mediate' before hand? Thanks!

    Oh Gawd are you saying you never actually submitted a decent defence AND you haven't submitted a court 'bundle of evidence/witness statement' either, despite a letter from the Court giving you a deadline to do so (the letter which gave you the Court date told you what to do and by when)?

    You can't just rock up and argue the case on the day, the judge won't let you say anything not already in your defence document.

    BUT - of course you have to turn up, unless you want to lose (you WILL lose if you don't appear).

    Oh, and be ready for the legal rep to try to intimidate you outside and to try to convince you to pay.

  • Could anybody help me at all...
    I've just received a letter say I have a parking fine of £100 for parking in a home base car park
    Now here's my argument...
    The company have an agreement with the school my son attends and have done for several years stating parents can park whilst dropping off/collecting their children, up to a maximum stay of 90 minutes per day.
    I have, along with other parents been using this system for several years never with any problems.
    I never ever go outside of this time, I work from home and have to work during the school hours so once I've dropped my son off I go, pick him up, leave and so on...

    Apparently on the 26th November 2014 they have clocked me staying there for 410 MINUTES!!!
    I'm absolutely furious! The picture they have taken of me arriving in the morning looks like it was bad weather so I'm assuming there was a problem with their camera, but I can guarantee I never stay in that car park, I very rarely even shop at that store so I know I wouldn't have stayed for anything!!!
    I'm so angry

    You do need to start a new thread of your own, as we work on the basis of 'one case, one thread' so advice doesn't become confused and/or we have a complete free for all with any number of random cases being tagged on.

    But first of all you do need to read thoroughly the NEWBIES FAQS sticky at the top of the forum index (one page back from here) which will give all of the initial information you need. It was written by Coupon-mad, one of the country's most knowledgeable people in dealing with private parking tickets. You won't find anything more comprehensive than this anywhere online.

    The sticky is detailed and you might need a couple of 'passes' to digest it, so bite sized chunks with a cup of tea over a couple days might be the best approach. You do need to make the effort to do some research via the sticky before asking for further help from regulars - we are so busy each day it's impossible to type and constantly repeat basic information - hence the sticky with all that stuff covered. But do come back after reading it if anything isn't clear to you.

    BUT - via a new thread of your own please.

    Go back one page from here (to the forum index), use the Forum Jump button (one at the top and one at the bottom r/h side of this page). Then, from the top of the forum index go down the page a few centimetres l/h side and you'll see a blue button 'New Thread' immediately above the green banner line 'Threads in Forum'.

    But you'd be better off at this stage reading the NEWBIES FAQ sticky before starting a new thread, because that's the reply/advice you're going to get when opening your new thread.

    Read the sticky, it will give you a better understanding about what this stuff is all about, then open your thread if there are things you then don't understand. Much of this is 'self-help' with forum regulars guiding you to success along the way.
