    I just saw this in MSE's template letter as a reason to reject a parking charge:
    I cannot afford to pay the fee
    I am a law abiding citizen and I made an honest mistake but I cannot afford the fee. Please see attached proof of my financial position as evidence.
    Would this actually work?? Surely that's admittance of guilt, acceptance of the charge, and they won't care if you tell them you're poor?

    Or is it trying to convince them that they won't get money from you even if they win?

    Totally ignoring that people have lost in court and that GPEOL is currently a nailed on win a popla.

    POPLA have been kind enough to tell us how to win! Under the header 'Key Case' on their website, they publish what they consider to be a Key Case considered by Lead Adjudicator Henry Michael Greenslade.

    They don't name the PPC but I know it's Parking Eye from the wording of the PPC's evidence (got the same in front of me on our bumf from PEye).

    Scroll down to the bottom and you'll see it's a 'no GPEOL' through and through.
    Appeal allowed.

    Yep but that version doesn't work against PPS (Premier Parking Solutions) in every case, for example. And more and more PPCs are trying to copy PPS' shiny new made up pile of drivel that they call a 'GPEOL statement'.

    And winning at POPLA doesn't tell you how to win at IAS, necessarily. People have lost cases at IAS and can't rely on no GPEOL. Soon I will re-write the NEWBIES thread to take account of the IAS issue and other things, as it needs to be a fluid document which changes to suit the PPC 'war'. Yep, I detest them and love to read of each battle won!

    @MSE Helen and @MSE Marcel, this unchanged old template needs to go into the bin right now (please!!) as you will cause people to lose at POPLA and in court with this:

    And this from the 2013-2014 annual report of Popla, surely you should go on the most up to date figures?

    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

  • I hope that you will include the the updated guide the need to rebut any evidence packs supplied to the motorist.

    NB this is for POPLA appeals only and BPA members as with the IPC this is another serious flaw in their make up that no evidence is supplied to the motorist.


    We are now seeing some very creative attempts to justify GPEOL by certain parking companies and those that come via our company are rebutted in every case. We upload those known as additional evidence to POPLA appeals eg for VCS and Excel etc.



    Sadly JAS Parking weren't too keen that their evidence pack was rebutted.

    Re rebutting POPLA evidence packs by emailing POPLA, the trouble is I don't think the Guide can cover a template for that as well except just by saying something general like:

    'do read and be ready to rebut and have the last word, about the evidence the PPC sends to POPLA as they have to copy you in as well. If the BPA member PPC appears to be arguing the charge was a GPEOL then decide how to rebut their figures, as well as pointing out to POPLA any errors in evidence (quickly by email to POPLA) before the decision is made'.

    But sadly there is no chance to rebut IPC/IAS evidence as the appellant doesn't see it.

    This is what I'm keen to see. Virtually every thread on here is about appealing/winning at POPLA. I don't see anything about appealing to IAS, let alone winning! Which is what I will be tackling soon once I receive a NTK from PCM. *concerned/slightly worried smiley face!*
