    What this ultimately comes down to is that our freedoms are eroded if we allow any organisation to come along and set their own "laws" for us to obey. There is one Law, and that is that.

    If Tesco's want to have a comprehensive and completely binding contract governing their Clubcard, let them do that, let them use way more diligence in creating those rules so that they are completely comprehensive, and let them operate them with a degree of responsibility and diligence that they presently do not seem capable of.

    In short: real Law, not Tesco-Lore.

    As someone who lives under TV Licensing-Lore, I can tell you that it isn't pleasant. When it happens to you, don't say you weren't warned.

  • What I find shocking and rather sinister is that some members on this thread would be quite happy to see a young man, just started uni, aged 18? and just starting out in life to be criminalised for such a trivial matter that I maintain does not even meet the threshold of a criminal act to satisfy the ridiculous legislation posted in #6.

    The police were not called. The OP was not arrested, never mind charged, convicted and received a criminal rap sheet. He was invited to leave the store and banned from further entry.

    What could you have possibly considered in such a short space of time?

    The OP says he was "taken" to a back room. That is all, that is it.

    He doesn't say he was asked, he was "taken".

    The OP then says he was told his crime was considered the same as "ordinary" shoplifting.

    Therefore, it is quite easy to conclude that, as with any shoplifter who gets caught, being "taken" away would mean having no choice in the matter.

    And we know that the appropriate action by Tesco's own terms of contract was to simply confiscate his clubcard to cancel it or, better still, simply told he was unable to do it.

    Nothing I am making up here. And I have a good grasp of the situation.

    Wow, you've really got the bit between your teeth because of this 18 minutes it took me to reply. Ive lost count the amount of times you've brought it up! Well I still stand by what I posted all these weeks later.

    You still twisting the situation to fir your own argument. No-where does the OP say he was forced to go with security or man handled into a back room or that they refused any request he made to leave. As such, your now trying to say "taken" means force against his will!

    These situations are best dealt away from the public as some people I presume would find it quite embarrassing to be caught out trying to defraud.

    Exactly. I think the OP got off rather lightly. Police were not involved, got to keep his clubcard account with however many points he had and only received a ban from the store.

    You're missing the point - whether he got off lightly or not, Tesco was never authorised to be Judge, Jury, or even Policeman.

    Tesco wasn't judge, jury or policeman. The OP wasnt arrested, convicted nor sent to court. I dont know what you keep bringing this up as its not relevant.

    Just as you and everyone else, I can refuse someone entry to my property. This is what Tesco have done. Nothing illegal and perfectly within their rights.

    The receipt dosent have to say that. The T&C's the OP agreed to when he signed up to the clubcard advise that points cant be transferred.

    "Clubcard accounts, cards, key fobs, coupons, points and vouchers cannot be transferred, bought, sold or in any way traded"
    But they can; I have transferred clubcard points to another person.
